Abstract

V naravi orožja je, da gre za izrazito problematično tematiko, ki terja restriktiven pristop pri urejanju zakonodaje. Tudi na tem področju načelo zakonitosti zahteva, da so državni organi pri svojem odločanju strogo vezani na ustavo in druge predpise. Upravni organ zasleduje javni interes v smeri, ki jo nakaže že zakonodajalec. Vprašanja v zvezi z orožjem niso samo stvar zgodovine. Strelno orožje je vedno bolj aktualna tema, v zadnjem času pa dobiva tudi možne politične razsežnosti. Z vstopom v Evropsko unijo in druge integracije je Republika Slovenija podvržena pravnemu redu Evropske unije, ki v zvezi s strelnim orožjem postavlja dodatne zahteve. Poleg problemov, ki se nanašajo na veljavno zakonsko ureditev orožnega prava, kot je nabava, nošenje in trgovina, se pojavlja tudi problematika, ki je povezana z ilegalno posestjo strelnega orožja. S svetovno globalizacijo in pojavom internetne trgovine pa je postalo posebej problematično področje deaktiviranega strelnega orožja, ki zaradi pasivnosti uradnih organov omogoča posameznikom, nagnjenim k kršitvam javnega reda oziroma javne varnosti ter kriminalnim družbam, nakup takega strelnega orožja in njegovo ponovno usposobitev brez ustreznega nadzora. Temu problemu se ni mogoče izogniti niti na notranjem trgu Evropske unije, kjer tovrstno blago potuje iz ene države članice v drugo brez ustreznega nadzora in zagotavljanja sledljivosti, tako kot to velja za registrirano delujoče strelno orožje.

Secondary abstract: The nature of the weapon is that it is a highly problematic theme, which requires a restrictive approach in regulating legislation. Also in this area the principle of legality requires that the state authorities in their decisions strictly bound by the Constitution and laws. Administrative authority pursues the public interest in the direction that you already paid the legislature. Issues relating to weapons are not just a matter of history. Firearms are an increasingly topical issue in recent times is getting the potential political implications. By joining the European Union and other integration is subject to the Republic of Slovenia with the acquis, in connection with firearms makes additional requirements. In addition to problems relating to the current regulation of firearm law, such as purchase, carry and store, there is also problems associated with illegal possession of firearms. With the globalization of world trade and the emergence of the Internet has become particularly problematic area of deactivated firearms, that the inactivity of the official bodies to individuals prone to breaches of public order or public security and criminal gangs, the purchase of such weapons, and his reactivating without proper supervision. This problem can not be avoided even in the internal market of the European Union, where such goods are traveling from one Member State to another without proper supervision and ensure traceability, as is the case for operating a registered firearm.
