Abstract

Osrednji predmet raziskovanja te diplomske naloge je Poročilo »Hipoteka v tranzicijskih ekonomijah« (v nadaljevanju diplomskega dela »Poročilo«) Evropske banke za obnovo in razvoj, ki ga je izdala leta 2007. Poročilo podaja celosten vpogled v stanje hipotekarnih trgov in zakonov s tega področja v državah, ki imajo dejaven trg s hipotekami ali ga aktivno razvijajo. Države, zajete v Poročilu so: Bolgarija, Hrvaška, Češka, Estonija, Gruzija, Madžarska, Kazahstan, Kirgizija, Latvija, Litva, Poljska, Romunija, Rusija, Srbija, Slovaška, Slovenija in Ukrajina. Poročilo želi opredeliti, kakšna pravna reforma je v teh državah potrebna, da bi dosegle učinkovito pravno podlago za ustanavljanje in uveljavljanje hipotek tako, da bi hipoteka predstavljala učinkovito sredstvo zavarovanj posojil. V prem delu diplomske naloge bom predstavila vsebino Poročila in razloge, zakaj je bilo izdano. Vsebinski del Poročila vsebuje: Razlago pojma pravne učinkovitosti, Hipotekarno pravo, Regionalno raziskavo o hipotekah in primerjalni pregled, Hipotekarne vrednostne papirje in zaključek. Še posebej bom v okviru tega Poročila izpostavila omembe Slovenije, kako je naš pravni sistem v Poročilu obravnavan in ocenjen. Nadalje bom predstavila odziv Poljske fundacije za hipotekarne kredite na Poročilo, njeno kritiko in konstruktivne predloge k temu Poročilu. S pričujočo diplomsko nalogo želim prikazati pogled Evropske banke za obnovo in razvoj na države, ki so pred kratkim prestale prehod v drugačen politični in gospodarski sistem, in njeno videnje stanja in razvoja hipotekarnega prava v obravnavanih državah ter usmeritve nadaljnjih reform, ki jih predlaga in podpira.

Secondary title: THE REPORT OF EUROPEAN BANK FOR RECONSTRUCTION AND DEVELOPMENT ON MORTGAGE IN TRANSITION ECONOMIES
Secondary abstract: The main subject of present thesis is the report »Mortgage in transition economies« (from here on called “the Report”), issued in year 2007 by European bank for reconstruction and development. The Report gives full overview of mortgage markets and laws in transition countries at present time. The following countries are included in the Report: Bulgaria, Croatia, The Czech Republic, Estonia, Georgia, Hungary, Kazakhstan, Kirgizstan, Latvia, Lithuania, Poland, Romania, Russia, Serbia, The Slovak Republic, Slovenia and Ukraine. The Report tries to determine, what kind of legal reform is necessary in these countries, so they could achieve an efficient legal framework for creating and enforcing mortgages in a way, that a mortgage would represent an efficient means for securing loans. First of all I will concentrate on the Report, why it was written and issued and present the contents of the Report in detail. Contents include: The explanation of the concept of legal efficiency, Mortgage law, Regional mortgage survey and comparative overview, Mortgage securities and conclusion. I will especially point out Slovenia, when mentioned in Report and how is our legal system treated and valued. In second part I will present the reaction of Polish mortgage credit foundation, its critique and opinion on the matter. With my thesis I would like to show the view of European bank for reconstruction and development on countries which have recently gone through the transition to different political and economic systems and their current condition and development of mortgage law, including its remarks and recommendations for future mortgage law reforms.
