Abstract

Lastnina je temeljna z ustavo in mednarodnopravnimi akti zagotovljena pravica. Zanjo so postavljene tudi meje dopustnosti poseganja vanjo. Omejitve lastninske pravice so dopustne le, če temeljijo na zakonu. Omejitve lastninske pravice lahko razdelimo na tiste, ki so določene v javnem interesu in tiste, ki varujejo zasebni interes. Predkupna pravica predstavlja omejitev avtonomije lastnika nepremičnine, s kom bo sklenil pravni posel. Lahko nastane na podlagi zakona – zakonita predkupna pravica ali na podlagi pravnega posla – pogodbena predkupna pravica. V svojem diplomskem delu sem predstavila predvsem pogodbeno predkupno pravico, ki predstavlja omejitev lastninske pravice v zasebnem interesu. Je obligacijska pravica in je povsem prepuščena avtonomiji volj pogodbenih strank.

Secondary title: Contractual pre-emption right as a form of restriction of property rights in the private interest
Secondary abstract: The property is a fundamental right guaranteed by the Constitution and international legal acts. The admissible limits of interfering into the property have also been set. Restrictions on the property rights are permissible only if they are based on the law. Restrictions of property rights can be divided into those that are stipulated in the public interest and those that protect the private interest. The pre-emption right represents the limitation of the autonomy of the property owner with whom he shall conclude the legal transaction. It may arise on the basis of the law - the statutory pre-emption right, or it may arise on the basis of a legal transaction - the contractual pre-emption right. The contractual pre-emption right, which represents the restriction of property rights in the private interest, is presented in my diploma paper. It is an obligation right, left entirely to the free will of contracting parties.
