Abstract

Vzpostavitev notranjega trga je zagotovila prost pretok blaga, oseb, storitev in kapitala. Pravni temelj s tega področja predstavlja PDEU, ki zagotavlja tudi prost pretok storitev in svobodo ustanavljanja. V prvem poglavju se tako seznanimo z oblikovanjem notranjega trga skozi zgodovino, podrobneje pa so predstavljena tudi načela, ki zagotavljajo nemoteno delovanje notranjega trga. Prosto gibanje oseb, kot ena izmed svoboščin, katera vključuje prosto gibanje ekonomsko aktivnih oseb, je predstavljeno v drugem poglavju. V tretjem poglavju je opredeljen pojem storitev in pogoji, da se neka oseba (fizična ali pravna) lahko sklicuje na to pravico. Kot pri vseh ostalih svoboščinah je tudi pri prostem pretoku storitev prepovedana diskriminacija. V veliko pomoč pri razlagi določb o prostem pretoku storitev sodijo tudi izjeme od pravila o prostem opravljanju storitev. Na kratko se seznanimo tudi z dvema direktivama, ki urejajo to področje, in sicer spoznamo Direktivo 2006/123/ES o storitvah na notranjem trgu in Direktivo 96/71 o napotitvi delavcev na delo v okviru opravljanja storitev. Za lažje razumevanje razmejitve med prostim pretokom storitev in svobodo ustanavljanja je v četrtem poglavju predstavljena razmejitev med njima z različnih vidikov. Svobodo ustanavljanja bomo spoznali skozi sodno prakso Sodišča EU v petem poglavju. Predstavljeni so najpomembnejši primeri, ki so znatno razširili pojem svobode ustanavljanja. Za vzajemno priznavanje poklicnih kvalifikacij je bil pomemben sprejem Direktive 2005/36/ES o priznavanju poklicnih kvalifikacij, zanemariti pa ne gre niti vloge Sodišča EU, zato sta predstavljena tudi dva primera sodne prakse s tega področja.

Secondary abstract: Establishing of the internal market has provided free movement of goods, persons, services and capital. TFEU which provides as well the freedom to provide and receive services and the freedom of establishment represents the legal basis from this field. Attaining an internal market through the history is introduced in the first chapter, principles that guarantee the realization of an internal market are introduced in details. Free movement of persons as one of the freedom which includes free movement of economically active individuals is introduced in the second chapter. Term services and the conditions that a person (natural or legal) can refer to this right are defined in the third chapter. As in all other freedoms discrimination in the freedom to provide and receive services is prohibited. Exceptions from the rule of free providing of services are in a lot of help with explaining the provisions about freedom to provide and receive services. Two directives which cover this field, Directive 2006/123/EC on services in the internal market and Directive 96/71/EC of posting of workers in the framework of the provision of services are shortly introduced as well. For better understanding of the limits between freedom to provide and receive services and freedom of establishment the limit between the two of them through different views is introduced in the fourth chapter. We will meet the freedom of establishment through the case law of EU court in the fifth chapter. The most important cases which highly expanded the term freedom of establishment are introduced. Adoption of Directive 2005/36/EC on the recognition of proffesional qualifications is important for recognition of proffesional qualifications, and we can't neglect the role of EU court, so two law case examples from this field are introduced.
