Abstract

Sistem evidentiranja nepremičnin je ključen za pravno varnost. Urejeno stanje na področju evidentiranja nepremičnim (tako v zemljiški knjigi kot tudi v katastru) je pogoj za varen promet z nepremičninami. Bolj je sistem natančen in celosten, večja je pravna varnost.Pri nas temelji evidentiranje nepremičnin na katastru (zemljiškem katastru in katastru stavb) in zemljiški knjigi. Kataster opisuje dejanske lastnosti nepremičnine, zemljiška knjiga pa je namenjena evidentiranju pravic in pravnih dejstev. Obe evidenci se med seboj dopolnjujeta in skupaj popolnoma opišeta nepremičnino. Namen mojega diplomskega dela je predstaviti bistvene značilnosti instituta etažne lastnine, opisati korake, ki jih je potrebno opravit, da se etažna lastnina vpiše. Poseben poudarek je namenjen upravnemu evidentiranju nepremičnin. Vpis v zemljiško knjigo je predstavljen na kratko zgolj zato, ker je vpis eden izmed pogojev za njen nastanek. Zemljiška knjiga je predstavljena zato, da se poda pregled nepremičninskih evidenc pri nas. Še posebej sem se posvetila katastru stavb in pogojem za vpis v kataster stavb, saj se moja tema — vzpostavitev etažne lastnine v povezavi z Zakonom o evidentiranju nepremičnin - bolj navezuje na kataster stavb in ne toliko na zemljiško knjigo.

Secondary abstract: Real estate registration system is essential to the legal security. Orderly state of the recording real estate ( in land registry and in cadastre) is condition for the safe transport with real estate. If the system is accurate and comprehensive, than the legal security is bigger.In Slovenia real estate registration is based on cadastre (land cadastre and cadastre of buildings) and on land registry. Cadastre describes the actual relations, land registry describes rights and legal facts. Both records complement each other and together they describe real estate completely.The intention of this thesis is to present essential features institution of condominium in our legislation. Then I would like to describe the progressive steps to enter the condominium in to the land registry. Special emphasis is devoted to the administrative real estate recording. Register in to the land registry is presented only briefly, because register in to the land registry is one of the conditions for formation condominium. Land registry is presented to provide a comprehensive overwiev real estates records in our country. I particularly focus on cadastre of buildings and conditions to register in to the cadastre of buildings, because my topic – Establishment of condominium ownership and the connection with real – estate recording act – is more relevant to cadastre of buildings, than is relevant to register in land registry.
