Abstract

Zaradi vse večjega staranja prebivalstva in zmanjševanja naravnega prirastka se povečuje povpraševanje po tuji delovni sili. Postopek zaposlovanja je odvisen od tega, ali tujec prihaja iz držav članic EU, EGP in Švicarske konfederacije ali pa iz t.i. tretjih držav. Za vse zaposlene delavce v Sloveniji ne glede na to, ali so slovenski državljani, državljani držav članic EU, EGP in Švicarske konfederacije ali pa državljani tretjih držav, velja, da so glede plače ter drugih delovnih pogojev povsem izenačeni. Delodajalec mora upoštevati določbe delovnopravne zakonodaje (Zakon o delovnih razmerjih, Zakon o varstvu pri delu) in kolektivne pogodbe. Državljani EU za zaposlitev v Sloveniji ne potrebujejo delovnega dovoljenja. Delavci iz držav članic EU morajo za zaposlitev v Sloveniji izpolnjevati enake pogoje kot domači delavci in imajo enake pravice ter obveznosti kot domači delavci. Postopek zaposlovanja državljanov tretjih držav poteka po Pravilniku o postopkih in dokazilih za odločanje o izdaji delovnih dovoljenj in določa postopke ter dokazila za odločanje o izdaji delovnega dovoljenja. Vlogo za izdajo delovnega dovoljenja je treba vložiti pri Zavodu Republike Slovenije za zaposlovanje (pri območni ali centralni službi zavoda).

Secondary title: Employment of foreigners in the Republic of Slovenia
Secondary abstract: Increasing demand for foreign labour is due to the intense ageing population and reduction of natural growth. Recruitment process depends on whether foreigner is coming from members of EU, EEA and Swiss Confederation, or foreginers of Third World countries. All workers in Slovenia, whether they are citizens of EU, nationals of EEA, Swiss Confederation or Third World countries have completely assimilated and equal rights regarding salaries and other working conditions. The employer must comply with the regulations of Labour Legislation (Labour Law Consolidation, Health and Safety Legislation at work) and collective agreements. Citizens from EU don't need working permits to perform their work. EU workers must qualify the same conditions and they also have the same rights and obligations as domestic workers. Process of recruitment for citizens of Third World countries is due according to the Procdure and Evidence Rules on issuing work permits. These rules also determinate procedure and evidence on issuing work permits. According to the ragulations all aplications must be filed with the Employment Office Republic of Slovenia.
