Abstract

Ustanovni akt javnega zavoda je temeljni akt, ki ga sprejme ustanovitelj ob ustanovitvi. Z njim se uredijo razmerja med ustanoviteljem in zavodom, določi se dejavnost, organi zavoda in način financiranja, vsebuje pa tudi ostale določbe ki se nanašajo na pravice, obveznosti in odgovornosti zavoda. Prvo poglavje govori o javnem zavodu in opredelitvi pojmov ter o definiciji javnega zavoda. Dotakne se tudi zgodovine, primerjalnega pogleda in preoblikovanja javnih zavodov. Drugo poglavje je namenjeno predstavitvi javnih zavodov v Mestni občini Murska Sobota in podlagam za sprejem njihovih ustanovnih aktov. Tretje poglavje govori o notranji ureditvi in sestavnih delih ustanovnega akta, metodah in načelih normativnega urejanja ter o zakonskih podlaga, postopku priprave in sprejemanju ustanovnega akta ter o razlogih za spremembe. Četrto poglavje pa govori o oceni stanja trenutne ureditve, o pomanjkljivostih in predlaganih spremembah obstoječe zakonske ureditve.

Secondary abstract:	The founding act of a public institution is a basic act adopted by the founder of the establishment. It regulates the relationship between the founder and the public institution and determines the activity, institution authorities and financing, it also contains other provisions relating to the rights, obligations and responsibilities of the Institution. The first chapter describes a public institution and its definitions. It also touches the historic view, and comparative view of the transformation of public institutions. The second chapter is devoted to the presentation of public institutions in the Municipality of Murska Sobota and to their basic instruments for founding acts of the public institutions. The subject of the third chapter is the internal structure and about components of the founding act of a public institution, about methods and principles of statutory regulation and the legal basis, the process of preparing and adopting the founding act and the reasons for the changes. The fourth chapter is about the assessment of the current regime of the deficiencies and proposed changes to existing regulations.
