Abstract

Etažna lastnina je poseben institut stvarnega prava. Njena posebnost se kaže v tem, da predstavlja lastninsko pravico na posameznem delu stavbe in hkrati solastninsko pravico na skupnih delih stavbe. Etažni lastniki se velikokrat ne zavedajo, da imajo poleg pravic tudi določene obveznosti in da je za mirno notranje sožitje v večstanovanjski stavbi pomembno, da so razmerja med njimi zakonsko urejena. Pomemben element povezan z etažno lastnino je njen vpis v zemljiško knjigo. Zaradi neurejenih razmer iz časov družbene lastnine še danes številna stanovanja niso evidentirana v zemljiški knjigi. Zakonodajalec sicer skuša z različnimi zakonskimi rešitvami to področje čim bolj urediti, vendar mu to še do danes ni popolnoma uspelo. Namen diplomske naloge je predstaviti ureditev etažne lastnine pri nas, torej opisati osnovne pojme povezane z etažno lastnino in vpis le-te v zemljiško knjigo. V diplomski nalogi obravnavam: pojem in pravno ureditev etažne lastnine, odstop etažne lastnine od dveh temeljnih načel stvarnega prava, skupne in posebne dele v etažni lastnini, nastanek, razpolaganje in prenehanje etažne lastnine, postopek vpisa etažne lastnine v zemljiško knjigo, na koncu pa še bistvene značilnosti posameznih zakonov, povezanih s področjem etažne lastnine.

Secondary abstract: Condominium is a special institute of property law. Its specialty is simultaneously reflected to the property right in a particular part of the building and co-ownership of common parts of multi-home building. Condominium owners are often unaware, that in addition to the rights and certain obligations for a peaceful coexistence in multi- home building is important, that relationship between them is regulated. An important element of condominium is linked to condominium land registration. The influence of dissorder in times of social ownership effected, that untill today many flats are not registered in the land register. Legislator tries with several legal solutions to edit the field of condominium, but has not been untill today fully succeeded. The purpose of this thesis is to present institution of condominium in our country, then describe the basic concept related to condominium and entering it into the land register. The thesis deals with: the concept and legal regulation of condominium, condominium assignment of the two fundamental principles of property law, common and individual parts, formation, disposition and termination of condominium, condominium registration into the land register, and in the end the main characteristics of individual laws relating to the field of condominium.
