Abstract
Znamka je pravica industrijske lastnine, ki varuje znak, pod katerim tržni subjekti ponujajo svoje blago in storitve. Ekonomski pomen znamk je pomemben tako z vidika potrošnikov kot tudi prodajalcev in proizvajalcev, zaradi česar je potreba po njihovi zaščiti nujna, razlogi pa številni. Podlago za pravno zaščito znamke predstavlja normativni okvir, ki ga tvorijo domači in mednarodni pravni predpisi ter pravo Evropske skupnosti. Pravice iz znamke se pridobijo s postopkom registracije, pri čemer je mogoče izbirati med registracijo na nacionalni ravni, na mednarodni ravni ali registracijo blagovne znamke Skupnosti. Na podlagi registracije pridobi imetnik znamke nekatera izključna upravičenja, katerih varstvo je pravno zagotovljeno. Posledica tega je, da lahko vsakomur, ki nima njegovega dovoljenja, v gospodarskem prometu prepreči uporabo enakega ali podobnega znaka, zavarovanega z znamko.
Vse nedovoljene oblike izkoriščanja imetnikovih pravic se štejejo za kršitve pravic industrijske lastnine, v takih primerih je (v odvisnosti od načina kršitve) mogoče zoper kršilca sprožiti ukrepe upravnopravne, civilnopravne ali kazenskopravne narave oziroma sporno razmerje urediti s pomočjo alternativnih načinov reševanja sporov. Največ težav imajo imetniki znamk v zvezi z uveljavljanjem pravic iz znamke v tretjih državah.

Secondary abstract: |
A trade mark is an industry property right devised to protect the sign under which commercial entities offer their goods and services. The economic value of a trade mark is vital, not only for the consumer but also for the seller and the manufacturer; this presents plenty of good and urgent reasons for the protection of trade marks. The regulatory framework for legal protection of brand rights consists of national and international laws, as well as laws and regulations of the European Community. The rights conferred by a trade mark are obtained through a registration process, where the applicant can choose between a national, international and a Community trade mark registration. The owner of a registered trade mark holds some exclusive proprietary rights which are legally protected. Through this registration, the owner may prohibit anyone without his given authorization from trading or using the same or similar sign protected by this trade mark.
Every unauthorized use of proprietary rights is considered a violation of intellectual property rights, in which case (depending on the type of the violation) administrative, civil or criminal measures may be taken, or an alternative way of resolving the issue be pursued. A major challenge for trade mark owners is protecting their trade mark rights in third countries. |
