Abstract

V diplomski nalogi se ukvarjam s pravico do ugovora vesti, bolj natančno ugovorom vesti zdravnika. V nalogi sem predstavila zakonsko ureditev ugovora vesti zdravnika v Sloveniji, v nadaljevanju pa tudi, v kakšnih primerih je ugovor mogoče uveljavljati. Iz tuje literature je razvidno, da je po svetu ta tematika veliko obravnavana zaradi nastalih problemov v praksi. Kolikor sem lahko razbrala iz slovenskih člankov in po pogovoru s strokovnjaki, zaenkrat hujših težav še ni, a kljub temu se situacija lahko kaj hitro spremeni. Na ta problem tudi opozarjam skozi svojo nalogo. V nalogi je prikazan tudi primerjalno pravni vidik ugovora vesti. Iz te primerjave je razvidno, da veliko evropskih in tudi drugih držav priznava to pravico. Nato sem tudi s pomočjo intervjujev poskušala ugotoviti, kako poteka postopek uveljavljanja pravice do ugovora vesti v praksi in kaj menijo zdravniki in drugi strokovnjaki o zakonski ureditvi te pravice. Na koncu sem izrazila še svoje mnenje v zvezi z obravnavano temo in kje vidim pomanjkljivosti zakonske ureditve ter kaj bi se v prihodnje dalo izboljšati na tem področju.

Secondary abstract: The thesis concerns the right of conscientious objection, more precisely conscientious objection of a doctor. In my thesis I present legal regulation of conscientious objection of a doctor in Slovenia and furthermore, where it can be used. From the foreign literature it can be seen that about this topic we can find a lot of writing and that they have already encountered problems in practice. As far as I emerge from the Slovenian articles and talking with experts for now there are no serious problems yet but nevertheless the situation can quickly change. This is what I also try to point out through my thesis. The thesis shows comparative legal aspects of conscientious objection. From this comparison it is clear that many European and other countries have included this right in their legislation. Moreover I tried to determine the process of using the right to conscientious objection in practice through interviews and find out what doctors and other experts think about the legal regulation of this right. In the end I have expressed my opinion on the topic and explained where I see the deficiencies of regulation and what more can be improved in this area in future.
