Abstract

Zdravniku je zaupana pravica, da odloča o občutljivih vprašanjih, ki zadevajo zdravje in življenje posameznika. Zdravnik je dolžan nuditi primerne zdravstvene storitve ob vsem spoštovanju človekovega dostojanstva, spoštovati pravice bolnikov, kolegov in drugih medicinskih sodelavcev, spoštovati zakone. Pri odnosu pacient — zdravnik, gre za odnos v katerega se vpletajo zdravnikova in pacientova čustva, izkušnje, lastnosti, pričakovanja,… Bistva zdravstvene dejavnosti ne predstavlja le strokovnost, temveč se od zdravstvenih delavcev pričakuje humanost, poklicna predanost, plemenitost, torej osebne lastnosti, ki se jih s kazenskopravno prisilo ne da izsiliti. Zdravnik mora v odnosu do pacienta ravnati z načeli etike. Njegova naloga je v prvi vrsti pomagati, nikoli škoditi in nikoli preveč obljubljati. Zaradi spoznanja, da gredo stvari v medicini narobe, tudi ob povsem pravilnem ravnanju, mora pacient vedeti, v kaj se pri določenem načinu zdravljenja podaja. Ravno zato je zelo pomembna pojasnilna dolžnost, ki jo opravi zdravnik. Zdravnik mora svoje delo opravljati profesionalno. Gre za profesionalno odgovornost, ki je v primeru zlorabe primerno sankcionirana. Zdravnik v primeru zapletov odgovarja objektivno, objektivno — subjektivno ali subjektivno.

Secondary abstract: The right to decide about delicate issues that concerns health and life oh an individual is entrusted to the doctor. He is obligated to provide adequate health services at all respect for human dignity, he must respect the rights of patients, colleagues and other medical staff, and he must respect the law. The relationship patient – doctor is the one, where the doctors and the patients emotions, experiences, characteristics, expectations,… are involved. Essential health activities represents not only profess Essential health activities represents not only professionalism, but also humanity, professional commitment, generosity, therefore, personal attributes that could not be forced by legal coercion. In the relationship between doctor and the patient, the doctor must act in accordance with ethics. Its role is primarily to help and never harm and never over - promise. Recognizing that things go wrong in medicine, even when fully correct conduct, the patient must know, what are the consequences of the specific medical treatment. That is why the explanatory obligation, given by doctor, is so important. The doctor must perform his work professionally. It is a professional responsibility, which is in case of abuse properly sanctioned. In case of complications, the doctor is responsible objective, objective – subjective and subjective.
