Abstract

Zaradi vse večje gospodarske krize, poslovnega neuspeha ali drugih vzrokov, se prezadolženost posameznikov opazno veča. Marsikdo v svojem življenju zabrede v velike finančne težave, katere je do leta 2008 reševal po svojih najboljših močeh. Za reševanje tovrstnih problemov je s 1. oktobrom 2008 v uvedbo stopil postopek osebnega stečaja. Tudi v Sloveniji je ta tema postala socialno družbeni problem, ki ga želijo z uvedba novega Zakona o finančnem poslovanju v postopkih zaradi insolventnosti in prisilnega prenehanja vsaj delno odpraviti. Nov zakon namreč vključuje postopek osebnega stečaja in stečaja zapuščine. Namen osebnega stečaja je poplačilo upnikov iz premoženja stečajnega dolžnika. S tem se preprečuje nadaljnje zadolževanje prezadolžene osebe in tudi povzročanje dodatnih dolgov. Postopek osebnega stečaja že nekaj časa poznajo moderne insolvenčne ureditve, v Nemčiji, Avstriji, ZDA in Franciji, kot tudi uredba Evropske unije. S sprejetjem tega zakona v slovenskem prostoru se dokončuje usklajevanje slovenskega prava s pravom Evropske skupnosti.

Secondary abstract: Given the growing economic crisis, business failure or other causes the over-indebtedness of individuals rises. Many people in their lives get into major financial difficulties which they had to solve on their own up until 2008. In order to solve such problems, personal bankruptcy proceedings were introduced on 1st October 2008. Even in Slovenia, this topic has become a social problem of the society that is intended to be at least partially removed by introduction of a new financial law of the insolvency proceedings and compulsory winding-up. The new law does include a personal bankruptcy proceedings and the legacy bankruptcy. The purpose of personal bankruptcy is a repayment of creditors from the assets of the debtor's bankruptcy. This is to prevent further borrowing of over-indebted persons and creation of a possible additional debt. The process of personal bankruptcy has already been introduced in modern insolvency regimes in Germany, Austria, USA and France, as well as to the regulation of the European Union. Adoption of this law in Slovenia is completion of adapting Slovenian laws of European Community.
