Abstract
Diplomska naloga govori o razvoju krajevnih skupnosti kot ožjih delov občine od njihovih prvih zametkov po narodnoosvobodilni vojni, do njihove formalne uvedbe z ustavo leta 1963 in do sedanje pravne ureditve. Z osamosvojitvijo Republike Slovenje je prišlo do uvedbe lokalne samouprave. Po Zakonu o lokalni samoupravi, je občina postala temeljna samoupravna lokalna skupnost. Pravica občine je, da na svojem območju ustanovi ožje dele občine, kot so krajevne, vaške in četrtne skupnosti. Ali bo občina ustanovila ožje dele občine je povsem odvisno od nje same.
Pred osamosvojitvijo Republike Slovenije je bil položaj krajevnih skupnosti drugačen. Tako imenovane komune so opravljale državne naloge na lokalni ravni, krajevne skupnosti pa so opravljale naloge lokalnega pomena, ki so služile zadovoljevanju potreb in interesov lokalnega prebivalstva.
Posebej je prikazana problematika krajevnih skupnosti v zvezi s priznavanjem pravne osebnosti, katera je podkrepljena z dvema analizama sodnih odločb, in sicer z eno sodno odločbo Vrhovnega sodišča Republike Slovenije in z eno ustavno odločbo Ustavnega sodišča Republike Slovenije. V nadaljevanju diplomske naloge je prikazana pravna ureditev krajevnih skupnosti v Občini Zagorje ob Savi. Podrobneje so predstavljene njihove naloge, organizacija in način financiranja. Poleg tega je prikazan dejanski primer razpada krajevne skupnosti Senožeti-Tirna v krajevno skupnost Šentlambert in krajevno skupnost Tirna.

The diploma work discusses the development of local communities as narrower sections of the municipality since their first inception after the National Liberation War and their formal introduction by the Constitution in 1963 as well as the current legal arrangements. Local self-government was introduced with the independence of the Republic of Slovenia. On the basis of the Law on Local Self-Government, the municipalities have become the basic self-governing local communities. Narrower sections of the municipality may be established within municipalities (local, village or quarter communities). The municipalities themselves determine whether such narrower sections will be established.
Before the independence of the Republic of Slovenia the local communities had a different role. The so-called communes carried out national tasks at the local level, whilst the local communities performed tasks of local significance in order to meet the needs and interests of the local population.
The diploma work specifically examines the issue of the recognition of the legal personality of local communities and analyses two court judgments, namely a court judgment by the Supreme Court of the Republic of Slovenia and a constitutional decision by the Constitutional Court of the Republic of Slovenia. In continuation, it describes the legal arrangements of local communities in the municipality of Zagorje ob Savi, presenting in detail their tasks, organization and financing. Furthermore, it describes the actual case of the disintegration of the local community of Senožeti-Tirna into the local communities of Šentlambert and Tirna. |
