Abstract

Diplomska naloga obravnava področje konkurenčnega prava, natančneje zlorabo prevladujočega položaja, pri čemer se opira na analizo konkretnega primera. V izhodišču so predstavljeni nekateri temeljni ekonomski in pravni koncepti, teorije in pravila, na katerih temeljijo namen, usmeritve in cilji konkurenčnega prava in so temeljnega pomena za ustrezno razumevanje in uporabo pravil, ki urejajo zlorabo prevladujočega položaja v praksi. V drugem delu diplomsko delo na konkretnem primeru, na podlagi odločbe Urada Republike Slovenije za varstvo konkurence št. 3073-9/02-4 z dne 4. maj 2004, osvetljuje ugotavljanje zlorabe prevladujočega položaja v praksi, pri čemer se osredotoča na vprašanja v zvezi z določitvijo upoštevnega trga, vezano prodajo ter omejevalnimi učinki, kakor so v obravnavanem primeru, kot posledica ravnanja podjetja Telekom d.d., ki je imelo prevladujoč položaj na trgu govorne telefonije, nastali na povezanem trgu storitev dostopa do interneta. Pri tem se diplomsko delo, izhajajoč iz dejstva, da slovenska konkurenčnopravna ureditev temelji na ureditvi EU, v pretežnem delu navezuje in opira na prakso institucij Evropske unije, to je Sodišča Evropske unije in Evropske komisije.

Secondary abstract: Thesis Abstract This thesis focuses on the subject of competition law, in particular the abuse of a dominant position in reliance on the analysis of a particular case. Initially, fundamental economic and legal concepts, theories and rules, on the grounds of which purposes, policies and objectives of competition law are established, therefore being essential for adequate understanding and practical use of rules governing the abuse of a dominant position, are presented. In the second part, this thesis enshrines assessment of abuse of a dominant position in practice by relating to decision no. 3073-9/02-4, dated May 6, 2004, issued by the Competition Protection Office of Republic of Slovenia, focusing on the issues regarding relevant market assessment, tied sales and restrictive effects on the related market of internet access services, resulting from the conduct of undertaking Telekom d.d. which held dominant position on the market of voice telephony. Flowing from the fact that Slovenian competition law regime largely depends on the EU regime this thesis substantially relates to and relies upon the practice of European Union institutions, such as Court of Justice of the European Union and European Commission.
