Abstract
V nalogi poleg podrobne predstavitve normativne ureditve na nivoju Evropske Unije in v Republiki Sloveniji predstavljam problematiko varstva osebnih podatkov pri zavarovalnicah. Opisujem varstvo osebnih podatkov, kakor jih opredeljuje Zakon o varstvu osebnih podatkov, kot tudi posamezni specialni zakoni, kot sta Zakon o pacientovih pravicah ter Zakon o zavarovalništvu.
V diplomskem delu predstavim osnove varstva osebnih podatkov, njihov pomen in njihovo varstvo. Za potrditev teze, da so osebni podatki, katere zahteva zavarovalnica zbrani nesorazmerno z namenom za katerega se potrebujejo, pa se poslužujem mnenj in odločb Informacijskega pooblaščenca ter pri tem ugotavljam ali sploh obstaja pravna podlaga za zbiranje osebnih podatkov zavarovancev.
Skozi raziskovalno delo ugotovim, da obstajajo različne pravne podlage za zbiranje osebnih podatkov zavarovancev, vendar pa je vseeno prisotno nesorazmerno zbiranje osebnih podatkov zavarovancev, vsaj kar zadeva zdravstveno dokumentacijo posameznikov. Pri tem je potrebno poudariti, da je vsak konkreten primer poseben in ga je potrebno obravnavati posamezno. Pri tem pa morajo upravljavci osebnih storitev, v tem primeru zavarovalnice, v nadaljnjem obdelovanju teh podatkov upoštevati načelo sorazmernosti ter poštenosti.

Secondary abstract: |
In this paper, in addition to detailed introduction to normative regulation on the European Union level and the level of the Republic of Slovenia, I present issues in the area of protection of insured people.
Throughout the paper I describe the institutes of protection of personal data as they are generally regulated in Personal Data Protection Act and specifically in Patients Rights Act and Insurance Act.
The leading thesis is that the personal data which is demanded from the insured is disproportionate to the purpose for which it is provided. To resolve this dilemma I include legal opinion and provisions given by Information Commissioner and discuss whether or not there is a legal ground for demand of certain information.
The research led me to the conclusion that there are different legal grounds for collecting personal data from the inured persons, however, the amount of gathered information is disproportionate at least in insured's obligation to provide their health documentation. Despite all this I have to designate the fact that there are considerable distictions from case to case and we have to take each and every one individually, and with this in their minds the insuring companies should account the principle of proportion and righteousness. |
