Abstract

Diplomsko delo obravnava mednarodno pravno problematiko otrok vojakov. Na začetku dela gre za opis in pregled najpomembnejših mednarodnih pravnih dokumentov na področju zaščite otrokovih pravic v oboroženih spopadih. Gre za splošne dokumente, ki ščitijo otroke kot del kategorije prebivalstva (Ženevske konvencije (I.-IV.), Konvencija o beguncih, Splošna konvencija o človekovih pravicah,…), ter dokumente, ki so namenjeni izključno za zaščito pravic otrok (Konvencija o otrokovih pravicah). V nadaljevanju so predstavljene temeljne smernice za varstvo in napredek pri zaščiti otrok, poleg tega pa so predstavljene tudi nekatere organizacije, ki so ključno vplivale na sprejem in sestavo omenjenih pravnih dokumentov. V diplomskem delu so opisane nekatere najhujše zlorabe otrok v vojnah, predstavljeni pa so tudi temeljni instituti, katerih glavna naloga je sankcioniranje le teh. Prav tako, je v povezavi z zlorabami otrok v vojni, opisan tudi pomen ter vloga mednarodnih sodišč in tribunalov. Diplomsko delo predstavlja predvsem normativni sistem zaščite otrok in ne gre dejansko za kritičen prikaz realnosti.

Secondary abstract: Diploma thesis deals with international legal issues related to child soldiers. The most important international legal documents that provide protection of children involved in armed combats are introduced first. These include general documents that protect children (Geneva Conventions (I.-V.), Convention relating to the Statue of Refugees, Universal Declaration of Human Rights...) and documents solely intended for protecting children’s rights (Convention on the Right of the Child). Child protection guidelines and descriptions of some organizations that had a key role in creation and adoption of above mentioned legal documents follow. The author describes some of the cruelest abuses of children in war and introduces institutions responsible for sanctioning these abuses. Furthermore he describes the role of international courts and tribunals. The main aim of this diploma thesis is not to criticize current legislation on this matter but merely to present normative system of child protection.
