Abstract
Diplomsko delo kompleksno obravnava problematiko pravice do zasebnosti, kot eno izmed temeljnih človekovih pravic in varstvo otrokove zasebnosti in njegovih osebnih podatkov pri uporabi svetovnega spleta s pravnega vidika.
Opredeljene so značilnosti pravice do zasebnosti, kot človekove in osebnostne pravice skozi njen zgodovinski razvoj. Opisani so vsi najpomembnejši pravni dokumenti, ki varujejo pravico do zasebnosti, tako v okviru mednarodne skupnosti, Evropske unije (EU) ter nacionalne zakonodaje.
Ker otroku pripadajo vse temeljne človekove pravice in svoboščine, v skladu z njegovo starostjo in zrelostjo, mu pripada tudi pravica do zasebnosti. Otroku je potrebno zaradi duševne in telesne nezrelosti nuditi posebno varstvo in skrb, zato je nosilec vseh posebnih pravic opredeljenih v Konvenciji ZN o otrokovih pravicah in Evropski konvenciji o uresničevanju otrokovih pravic. Zaradi boljšega razumevanja otrokove pravice do zasebnosti je pojasnjen pojem otroka in njegovo napredovanje od objekta k subjektu pravic. V delu me zanima kako se uresničuje otrokova pravica do zasebnosti v razmerju do staršev, ki imajo roditeljsko pravico, da varujejo otrokove koristi. Kje je meja med izvrševanjem pravice staršev in varovanjem otrokove pravice do zasebnosti? To je bilo pomembno vprašanje v tem delu naloge. Ker ima šola pomembno vlogo pri razvoju otroka, je opisan problem varovanja pravice otroka do zasebnosti v šoli.
Tudi otroci so zaradi razmaha svetovnega spleta in razvoja novih komunikacijskih-informacijskih tehnologij postali vsakodnevni uporabniki interneta, ki pa so med najbolj ogroženimi. V delu me zanima, kako je varovana otrokova zasebnost v virtualnem svetu. Kljub pozitivnim vplivom spleta v izobraževalne namene, so otroci vedno večja skupina udeležencev v spletnih socialnih omrežjih in drugih aplikacij. Otroci težko ločijo razliko med kršitvijo zasebnosti v resničnim in virtualnem svetu in se ne zavedajo nevarnosti zlorab, katerim so izpostavljeni na spletu. Ali lahko kljub vedno večjemu ozaveščanju varne rabe interneta govorimo o zasebnosti otrok na internetu? Kajti z razvojem spletnih tehnologij se z enako hitrostjo povečujejo načini zlorabe osebnih podatkov, od katerih je tudi nekaj predstavljenih. Menim, da so prav starši tisti, ki lahko otroka obvarujejo pred zlorabami z ustrezno programsko opremo in rešitvami, ki niso tehnične narave. V prihodnosti bo potrebno veliko truda vložiti v vzgojo otrok in jih podučiti o možnih zlorabah na spletu in zaščitami pred vdori v zasebno življenje.
Izmed mehanizmov za zaščito otrokove pravice do zasebnosti v primeru kršitve, izpostavljam sodno varstvo v civilnem in kazenskem postopku.

This thesis deals with the issue of the right to privacy as one of the fundamental human rights and the protection of children's privacy and their personal data when using the Internet from a legal point of view on a complex level.
I have identified the characteristics of the right to privacy as a human and personal right through its historical development. All the most important legal documents that protect the right to privacy within the international community, the European Union and national laws are described.
Children are entitled to all fundamental human rights and freedoms, in accordance with their age and maturity; consequentially they are also entitled to the right to privacy. Due to children’s mental and physical immaturity it is necessary to provide them special protection and care. They are the holders of all special rights defined in the UN Convention on Children's Rights and in the European Convention on the Exercise of Children's Rights. For better understanding of children's rights to privacy the concept of the child and his progress from object to the subject of rights is explained. In this work I am interested in how the child's right to privacy in relation to the parents with their parental rights that thereby protect the interests of their children is exercised. Where is the boundary between the implementation of parents' rights and protecting children's rights to privacy, has been an important issue in this part of the thesis. Since the school has a significant role in the development of a child it describes the problem of protecting children's rights to privacy at school.
At the rise of the Internet and the development of new communication - information technologies, even children have become everyday Internet users, who are the most exposed and therefore endangered. In this thesis I am interested in how the child's privacy is protected in the virtual world. Despite the positive impact of the Internet for educational purposes, children are a rising group of participants in online social networks and other applications. Children are not able to distinguish the difference between the breach of privacy in real and virtual world and are not aware of the danger of abuse that they face online. Can we, despite the increasing awareness of safe Internet use, talk about children's privacy on the Internet? Together with the development of online technologies, the increase of abuse of personal data is carried on with the same speed. Some abuses are presented. I believe that parents are the ones who can protect them from this kind of abuse by installing appropriate software and with solutions that are technical in nature. In the future a considerable effort will have to be invested in children's upbringing and the education on potential abuse on the Internet and protection from intrusions into private life will be crucial.
Among the mechanisms to protect children's rights to privacy in the event of a breach I set in the forefront juidical protection in civil and criminal proceedings. |
