Abstract

Diplomska naloga obravnava rastlinsko biotehnologijo v luči patentnega prava. Področje rastlinske biotehnologije je bilo s pravnega vidika zaradi svoje materije pogosto predmet različnih interpretacij. Rastlinska sorta, kot biotehnološki izum, je povzročila zmedo na področju patentov, saj vsekakor ne gre za klasično vrsto izuma. Vzporedno so se pojavila vprašanja, kdaj gre za novo rastlinsko sorto, kjer imetnik pridobi žlahtniteljsko pravico. Varstvo sort rastlin predstavlja obliko varovanja intelektualne lastnine na področju vzgoje novih sort rastlin. Tudi kasnejši razvoj genskega inženiringa je postavil nove meje interpretacije v pravnem smislu. Prikazana je podrobna analiza člena 53(b) Evropske patentne konvencije (EPK), ki določa izjeme glede možnosti patentiranja. Interpretacija omenjenega člena temelji na praksi primerov Evropskega patentnega urada (EPU). Pristojni organi so se trudili izdelati smiselne odločitve glede patentnih zahtevkov ter podati pravno stališče spornih vprašanj s področja patentne zakonodaje. Pomemben akt, ki je dopolnil Evropsko patentno konvencijo, je leta 1998 sprejeta Direktiva 98/44/ES o pravnem varstvu biotehnoloških izumov, ki je za namene patentiranja biotehnoloških izumov določila nekatere posebnosti. Medtem ko je patentna zakonodaja vsake država nekoliko drugačna, pa so zahteve in pravice iz dodeljenih patentov vsebinsko podobne. Prikazana je ureditev ameriškega patentnega sistema glede možnosti patentiranja rastlinskih sort ter nekatere bistvene razlike z evropskim patentnim sistemom.

Secondary abstract: The thesis deals with plant biotechnology in light of patent Law. Area of plant biotechnology in legal aspect has been often subject matter of different interpretations. Plant variety, as a biotechnological invention, has led to confusion in the field of patents, because it certainly is not a classical type of invention. In parallel, questions have been raised when there is a new plant variety, where the owner acquires the breeder's right. Plant variety protection constitutes a form of intellectual property protection. Also the later development of genetic engineering has set new limits of interpretation in patent Law. The diploma work presents detailed analysis of Article 53(b) of the European Patent Convention (EPC), which provides exceptions to patentability. The interpretation of that article is based on practical examples of the European Patent Office (EPO). The competent authorities have tried to make meaningful decisions on patent applications and to provide the legal position of the issues in the field of patent Law. An important document that has reached the European Patent Convention was Directive 98/44/EC on the legal protection of biotechnological inventions, which identified some specific features for the purposes of biotechnology patents. The patent Law of each country are somewhat different, but the requirements and rights under granted patents are substantially similar. Some essential differences are featured between the views of European and American patent system as regards the patentability of plant varieties.
