Abstract
V delovnem pravu se srečujejo različni in mnogokrat tudi nasprotujoči interesi udeležencev delovnih razmerij, torej delavca in delodajalca na individualni ravni. Različni interesi pogosto vodijo v razvoj in nastanek individualnih delovnih sporov, ki se lahko rešujejo na različne načine. Poleg sodnega reševanja delovnih sporov, ki je najpogostejši način reševanja sporov v Sloveniji, se v praksi uporabljajo tudi alternativni načini reševanja nastalih sporov.
Med alternativne načine reševanja individualnih delovnih sporov uvrščamo v praksi in teoriji poznano arbitražo, vse bolj prodirajočo mediacijo, ter nekatere druge načine alternativnega reševanja sporov.
Reševanje individualnih delovnih sporov z mediacijo se pospešeno razvija od sprejetja Direktive 2008/52/ES Evropskega parlamenta in Sveta z dne 21. maja 2008 o nekaterih vidikih mediacije v civilnih in gospodarskih zadevah. Navedena direktiva je bila vir za pripravo Zakona o mediaciji v civilnih in gospodarskih zadevah (ZMCGZ) iz leta 2008, ki velja tudi za individualne delovne spore. Navedeni zakon vsebuje številne formalne in procesne določbe, ki jih morajo upoštevati tako mediatorji kot stranke. Zakon o alternativnem reševanju sodnih sporov (ZARSS), ki je bil sprejet v letu 2009, ureja reševanje sodnih sporov in se lahko uporablja le v primeru, ko je tožba pred delovnim sodiščem že vložena in ko sodišče ponudi strankam reševanje spora z mediacijo. Na podlagi ZARSS sta bila dne 15.3.2010 izdana Pravilnik o mediatorjih v programih sodišč in Pravilnik o nagradi in povračilu potnih stroškov mediatorjem, ki delujejo v programih sodišč.
Leta 2008 je začel veljati nov Zakon o arbitraži, katerega določbe se uporabljajo tudi za arbitraže v individualnih delovnih sporih. Arbitražno reševanje individualnih delovnih sporov je posebna izvensodna oblika reševanja sporov, za katero je značilno, da je dopustna le pod pogojem, da je prostovoljna. Prednosti, ki jih prinaša arbitraža v primerjavi s sodnim načinom reševanja sporov, so številne.
Alternativno reševanje sporov se danes, tako v Sloveniji kot tudi po svetu, pogosto poudarja predvsem v zvezi z zmanjšanjem sodnih zaostankov in razbremenitvijo sodišč. Eden bistvenih razlogov za uporabo tega postopka je, poleg prihranka časa in denarja, zlasti negativen vpliv pravdanja na stranke. Število sodnih postopkov se namreč povečuje, postopki se podaljšujejo, posledično pa naraščajo tudi njihovi stroški.

Alternative resolution of individual labour disputes |

Different and often conflicting interests of participants in the employment relationships (employees and employers on an individual level) are encountered in labour law. Various interests often lead to the development and creation of individual labour disputes which can be resolved in different ways. Alternative ways of solving labour disputes are used in practice in addition to the judicial settlement, which is the most common way of resolving the disputes in Slovenia.
The arbitration, which is well-known in practice and in theory, the increasingly penetrating mediation and some other methods of alternative dispute resolution are being classified among alternative ways of resolving individual labour disputes.
The resolution of individual labour disputes through mediation has been evolving rapidly since the adoption of Directive 2008/52/EC of the European Parliament and of the Council of 21 May 2008 on certain aspects of mediation in civil and commercial matters. That directive was the source for the preparation of Mediation in Civil and Commercial Matters Act from year 2008, which also applies to individual labour disputes. This Act contains a number of formal and procedural provisions, which have to be taken into account by the mediators as well as the parties. Act on Alternative Dispute Resolution in Judicial Matters, which was adopted in 2009, governs the resolution of legal disputes and can be used only when the action brought before the Labour Court has already been filed and when the parties are offered by the court to resolve the dispute through mediation. Rules on mediators in the programs of the court and Rules on awards and reimbursement of travel expenses of mediators, acting in the programs of the courts were issued March 15 2010 on the basis of Act on Alternative Dispute Resolution in Judicial Matters.
The new Arbitration Act entered into force in 2008, and its provisions also apply to arbitration of individual labour disputes. Arbitral resolution of individual labour disputes is a special non-judicial form of dispute resolution, which is permissible only under one condition – it must be voluntary. The advantages offered by arbitration are numerous in relation to judicial method of dispute resolution.
Nowadays, in Slovenia and around the world, alternative dispute resolution is being often emphasized in connection to reducing the court backlogs and court reliefs. One of the key reasons for using this procedure, in addition to saving time and money, is especially the negative impact of litigation on the parties. The number of judicial proceedings is arising, procedures are being prolonged, and consequently their costs are increased. |
