Abstract

Od vstopa Republike Slovenije v Evropsko unijo se policija in sodišča v praksi pogosto srečujejo s primeri obravnave tujcev - državljanov Evropske unije kot storilcev različnih kaznivih dejanj in prekrškov. Navedeni tujci že po pravu Evropske unije, kot tudi po slovenskem pravu, uživajo posebne pravice, med njimi tudi pravico do prostega pretoka oseb. Kot antipod, pravo EU državam članicam dovoljuje omejene posege v navedeno pravico, predvsem iz razlogov varovanja javnega reda in javne varnosti, pri čemer postavlja tudi natančne pogoje, ki dopuščajo njihovo uporabo. S temi ukrepi države članice zagotavljajo varnost svojih državljanov in varnost lastne ustavne ureditve. Diplomska naloga je vsebinsko razdeljena na tri sklope. V prvem sklopu je predstavljena problematika trenda kršitev s področja prekrškovnega prava, na katerega je vplival vstop Republike Slovenije in drugih novih držav članic v Evropsko unijo, predstavljeni pa so tudi ukrepi izgona tujca iz države. V drugem sklopu je obravnavana »evropska ureditev« pravice do prostega pretoka oseb, z nekaterimi primeri sodne prakse Sodišča Evropske unije, predstavljena pa je tudi direktiva Evropskega parlamenta in Sveta 2004/38/ES kot relevantna evropska zakonodaja s tega področja. Tretji sklop pojasnjuje ureditev instituta izgona tujca v nacionalnem prekrškovnem in kazenskem pravu, s poudarkom na posebnostih ureditve prekrškovnega prava.

Secondary abstract: Since Slovenia joined the European Union the police and courts in practice are often confronted with cases of treatment of foreigners - citizens of the European Union and perpetrators of various crimes and misdemeanors. Those foreigners, on the basis of European Union law, as well as under the Slovenian law, enjoy special rights, including freedom of movement. As an antipode, EU law allows Member States a limited intervention in that right, especially on the grounds of protecting public order and public security, and also sets specific conditions that allow their application. With these measures Member States shall ensure security of their citizens and the security of their own constitutional arrangements. The present work is divided into three sections. The first part presents the problem of trend in the field of misdemeanor violation of the law affected by the entry of Slovenia and other new Member States in the European Union, and it also presentes measures of foreigners expulsion from the country. In the second part the EU legislation of the right of free movement of persons is considered and presented with some case law of the European Union Court of Justice. The directive of the European Parliament and the Council 2004/38/EC is also presented as relevant EU legislation in this field. The third set clarifies the concept of expulsion in the national misdemeanor and criminal law, focusing on the specifics of the offense law regime.
