Abstract

S preučevanjem ene temeljnih človekovih pravic, tj. pravico do enakopravne obravnave in prepovedi diskriminacije na podlagi katerekoli osebne okoliščine, s svojim diplomskim delom utemeljujem pomen te pravice pri zdravstveni obravnavi pacientov. Ravno njen univerzalni pomen nas pripelje do zakonske ureditve in ustreznega pravnega varstva, ter postopkov v primeru kršitev te pravice pacienta. Neenakosti pri obravnavi in dostopu do zdravstvene oskrbe so sicer urejene s številnimi splošnimi in specialnimi mednarodnimi in evropskimi pravnimi akti, ki Sloveniji kot podpisnici le-teh, daje smernice in jo zavezuje k primerni zaščiti pacientovih pravic. Kljub temu je vprašanje tako pomembno, da zahteva tudi notranjo normativno ureditev, zato je bil leta 2008 sprejet Zakon o pacientovih pravicah, kot specialen zakon in ureja vprašanje, ki je splošno urejeno že z Ustavo RS. Vsebinski del diplomske naloge zato podrobno razčlenjuje ZPacP, ki določa pravice in dolžnosti pacientov in pred izvajalci zdravstvenih storitev ščiti zlasti ogrožene skupine pacientov. Po priporočilih Evropske listine o pacientovih pravicah, jim daje štirinajst pravic, med katerimi je tudi pravica do enakopravne obravnave in dostopa do zdravstvene oskrbe in je konkretizacija ustavnega načela prepovedi diskriminacije.

Secondary abstract: With the interpretation of one of the fundamental human rights, the right to equal treatment and non-discrimination based on any personal circumstance I certify in my thesis the importance of this right for patients in medical treatment. It is universal meaning leads to its regulation and adequate legal protection in case of infringement. Inequalities in treatment and access to health care are otherwise regulated by a series of general, and specialized international and European legal acts that Slovenia as a member must consider guidelines, when providing appropriate protection of patients rights. Nevertheless, the issue is very important, so therefore it requires an internal regulatory framework. In 2008, the Law on Patients Rights was certified as a special law covering a question that is generally already regulated by the Constitution. Contents of thesis gives a detailed breakdown of the relatively new legislation determening the rights and duties of patients, and healthcare providers, while protecting particularly vulnerable groups of patients. Following the recommendations of the European Charter of Patients Rights the law is consistent of fourteen patients rights including the right to equal treatment, and access to health care, and the implementation of the constitutional principle of non-discrimination.
