Abstract

Javne službe so družbi nujno potrebne, saj se preko njih zadovoljujejo potrebe po javnih dobrinah in storitvah, ki jih v javnem interesu trajno in nemoteno zagotavlja država oziroma lokalna skupnost, kadar in v kolikor jih ni mogoče zagotavljati na trgu, pri tem pa njihov prvenstveni cilj ni pridobivanje dobička. Javne službe delimo na gospodarske in negospodarske. Negospodarske javne službe ureja Zakon o zavodih /ZZ/ (Uradni list RS, št. 12I/1991, 45I/1994 Odl.US: U-I-104/92, 8/1996, 18/1998 Odl.US: U-I-34/98, 36/2000-ZPDZC, 127/2006-ZJZP). ZZ v 1. členu opredeljuje negospodarske javne službe oziroma dejavnosti, ki jih le-te zajemajo, to so pa so: vzgoja in izobraževanje, znanost, kultura, šport, zdravstvo, socialno varstvo, otroško varstvo, invalidsko varstvo, socialno zavarovanje ali druge dejavnosti, če njihov cilj ni pridobivanje dobička. ZZ pa ureja le statusna vprašanja, ki so skupna za vse vrste zavodov na posameznih področjih družbenih in drugih negospodarskih dejavnosti. S posebnimi zakoni, ki urejajo posamezna področja teh dejavnosti, pa so posamezna vprašanja urejena drugače, upoštevaje pri tem specifičnosti posameznih dejavnosti in vrst zavodov. Negospodarske javne službe se izvajajo v naslednjih oblikah: javni zavodi (brez in z subjektiviteto), zavodi s pravico javnosti, koncesija negospodarske javne službe, javno-zasebno partnerstvo.

Secondary abstract: Public services are an essential part of society; they contribute to public welfare and provide services, which are in public interest permanently and continuously provided by the state or municipal community with non-profit interests. There are two types of public services: commercial and non-commercial. The latter ones are regulated by the Institutions Act, which in Article 1 defines them as comprising of education, science, culture, sport, health care, social care, childcare, protection of persons with disabilities, social insurance and other activities if they have a non-profit purpose. Institutions Act regulates only corporate issues common to all types of institutes in individual areas of social and non-commercial activities. Considering the uniqueness of activities and types of institutes, some issues are differently governed by special acts regulating individual areas of these activities. Non-commercial public services are performed by the following services: public institutes (without and with legal personality), institution with public rights, non-public service concession, public –private partnership.
