Abstract

Evropska državljanska pobuda je instrument neposredne demokracije, katerega namen je omogočiti višjo stopnjo sodelovanja državljanov Evropske unije v osrednjih političnih evropskih zadevah. Instrument daje pravico najmanj milijonu državljanov Evropske unije, da od Komisije EU zahtevajo pripravo novega zakonodajnega predloga. Ideja o evropski državljanski pobudi je zorela že desetletja, s širitvijo Evropske unije pa je prerastla v potrebo po instrumentu, ki bi državljane Evropske unije identificiral z Evropsko unijo in premoščal njihovo odtujenost od evropske politične elite. Gotovo ni naključje, da se uresničuje ravno v dobi, ko je zbiranje široke podpore po državah članicah Evropske unije, ki jo instrument za svoje delovanje potrebuje, s pomočjo socialnih omrežij, ki jih zagotavlja svetovni splet, zelo olajšano in ne more biti slučaj, da se je ideja začela udejanjati ravno v času največje krize Evropske unije in evropske valute. Cilji instrumenta bodo lahko v praksi doseženi zgolj v primeru, da bo sistem evropske državljanske pobude deloval. V strokovni javnosti instrument vzbuja tako pozitivna kot negativna pričakovanja. Kritiki Uredbe EU št. 211/2011 opozarjajo, da je postopek preveč kompleksen in predolg . Hkrati pa instrument vzbuja močna pričakovanja in vzbuja optimizem, kar v primeru nemožnosti realizacije lahko deluje ravno nasprotno od želene smeri – v poglabljanje odtujenosti evropskih državljanov od evropskih institucij . Ni mogoče prezreti dejstva, da je predpisani postopek res zapleten, vendar bo to oviro dober organizator zagotovo prešel. Bolj zaskrbljujoče je dejstvo, da evropska državljanska pobuda predstavlja zgolj predlog za oblikovanje načrta, ki Komisijo EU samo spodbuja, ne pa tudi zavezuje k ukrepanju na zakonodajnem področju. Komisija EU se tako lahko odloči, da ne bo sprejela nobenih ukrepov glede predložene evropske državljanske pobude, kar zanjo ne predvideva nobenih sankcij. Končna odločitev je v rokah Evropskega parlamenta in Sveta, saj se kot zakonodajalca lahko odločita, da ne bosta sprejela predloga pravnega akta Komisije EU, ki ga je ta dala na podlagi predlagane evropske državljanske pobude. Vsekakor menim, da je prav, da evropsko državljansko pobudo v začetnih korakih njenega uresničevanja v praksi pospremimo z optimizmom, ob tem pa verjamemo, da bo Komisija EU v fazi spremljanja njenega delovanja zaznala vse pomanjkljivosti postopka in tudi predlagala korektivne ukrepe, da bo zares lahko postala prvi korak k državljanski demokraciji v Evropi.

Secondary abstract: The European citizens' initiative is an instrument of direct democracy and its purpose is to enable the citizens of European Union a higher level of participation in central political european affairs. The instrument gives the right to at least a million of European Union citizens to demand the preparation of a new legal proposal by the European Commission. The idea on European citizens' initiative has been maturing for decades, but with the enlargement of European union it has grown into a need for an instrument which would enable the citizens of European Union to identify themselves with European Union and overcome their alienation from European political elite. It is certainly not a coincidence that it is being accomplished in the era when gathering wider support in European Union member states, which the instrument needs for its functioning, is facilitated by the help of social networks on world wide web, and it is not by chance that the idea began to pursue exactly at the time of the biggest crisis of European Union and European currency. The objectives of the instrument will in practice be achieved only in the event that the system of citizens' initiative will work. In a professional public instrument conveys both positive and negative expectations. Critics of Regulation EU No. 211/2011 warn that the process is too complex and too long . At the same time the instrument raises strong expectations and gives rise to optimism, which in the case of failure to the realization can work exactly the opposite from the desired direction – in deepening alienation of European citizens from the European institutions . One cannot ignore the fact that the prescribed procedure is really complicated, but a good organizer will definitely pass this barrier. More worrying is the fact that the initiative represents merely a proposal for the creation of an agenda that only encourages the European Commission but not binds it to take action in the legislative field. The European Commission may also decide not to take any action with respect to proposed initiatives, as it does not envisage any sanctions for it. The final decision is in the hands of European Parliament and of the Council, since as legislators they may decide not to accept the European Commission's proposal for a legal act, which it has proposed based on suggested citizens' initiative. However, I believe it is right that the citizens' initiative in the initial steps of its exercise in the practice is accompanied with optimism, but we believe that the European Commission will in a stage of monitoring its operation detect any deficiencies in the procedures and propose corrective measures, which would enable the citizens' initiative to really become the first step towards citizens' democracy in Europe.
