neskladnost 2. in 3. odstavka 66. člena ZPIZ-1 z Ustavo Republike Slovenije
Abstract
Republika Slovenija je socialna država, kar je navedeno v drugem členu Ustave Republike
Slovenije1. Upoštevajoč navedeno, prvi odstavek 50. člena Ustave RS zagotavlja državljanom
pravico do socialne varnosti, pod pogoji, ki jih določa zakon. Naveden člen Ustave RS
obvezuje državo, da z zakonom uredi obvezna socialna zavarovanja, torej tudi invalidsko
zavarovanje. Država je dolžna zagotoviti delovanje invalidskega zavarovanja, kar je storila z
zakonom o pokojninskem in invalidskem zavarovanju, ZPIZ-1. Ustava prepušča
zakonodajalcu, da v zakonu določi vsebino in obseg človekovih pravic. Vendar
zakonodajalčeva normativna dejavnost ni neomejena. Ko gre za človekove pravice so le-te
zaščitene z Ustavo RS.
V diplomskem delu je prikazan nedopusten poseg v človekove pravice. ZPIZ-1 namreč
nekaterim kategorijam zavarovancev odreka pridobitev pravic iz invalidskega zavarovanja v
primeru nastanka invalidnosti III. kategorije, samo zaradi njihovega statusa.

Republic of Slovenia is social state, as is regulated in article 2 of the Constitution of Republic of Slovenia. First paragraph article 50 of the Constitution of Republic of Slovenia insures citizens the right to social security under the conditions, which are regulated by law. Mentioned article from the Constitution obligate Republic of Slovenia for the regulation of social securities, also disability insurance. The state must guarantee working system of disability insurance, what Slovenia has already done it with the retirement and disability insurance act, ZPIZ-1.
The Constitution gives the legislative body the obligation to regulate extension and content of human rights in legislation, but the regulatory activity of the legislative body is not unlimited. When are human rights in question, those are protected with the Constitution of Republic of Slovenia.
In my diploma I will demonstrate the unconstitutional intervention in human rights. Retirement and disability insurance act denies disability insurance rights to some insured persons in case of becoming the third category of disability, just because of their status. |
