Abstract

Diplomsko delo se ukvarja s pojmom posilstva v sodobnem kazenskem pravu. V prvem delu obravnava pojem spolne samoodločbe posameznika v zvezi z njegovo »najbolj notranjo zasebnostjo« okrog katere se osredotoča varstvo človekove telesne notranjosti pred spolnimi napadi. V zgodovinskem pregledu je prikazan razvoj razmerja inkriminacije spolnega prisiljenja in posilstva. Posilstvo je težek primer kaznivega dejanja znotraj inkriminacije spolnega prisiljenja in pomeni posebno in hkrati temeljno – kvalificirano dejanje, kamor ga uvršča večina evropskih kazenskopravnih sistemov. Posilstvo je dejanje, ki je v prvi vrsti nasilno, to je storjeno brez soglasja žrtve, in (v drugi vrsti) seksualno. Konstitutiven element posilstva je spolno občevanje, ki je ena od najširše poznanih in razumljivih inkriminacij v vseh sodobnih kazenskih zakonih. Posilstvo je v osnovi agresivno dejanje in je simptom neke psihološke disfunkcije, bodisi začasne ali trajne. Storilci kaznivega dejanja so visoko heterogena populacija, ki ima močno izražene dimenzije osebnosti. Stereotipno dojemanje spolnih vlog in sprejemanje medsebojnega nasilja so povezani s sprejemanjem stereotipov o posilstvu.

Secondary abstract: The diploma thesis deals with rape in modern criminal law. In the first part, sexual self-determination of an individual is explored in relation with one's "innermost privacy", on which the protection of human physical interior self against sexual assault focuses. In the historical overview, the development of the relationship between incrimination of sexual coercion and rape is presented. Within incrimination of sexual coercion, rape is a serious criminal offence and a special as well as fundamental qualified criminal act, which is how most European criminal law systems classify it. First of all, rape is an act of violence committed without the victim`s consent, and second of all, it is sexual. The constituent element of rape is sexual intercourse, which is one of the most known and understandable incriminations in all modern criminal laws. Rape is basically an aggressive act and a symptom of a psychological dysfunction, either temporary or permanent. The offenders of this criminal offence are a highly heterogenous population with significantly expressed dimensions of personality. Stereotypical perception of sexual roles and acceptance of interpersonal violence are associated with acceptance of rape steteotypes.
