Abstract
Diplomska naloga obravnava sistem kazenskih sankcij za mladoletne storilce kaznivih dejanj v veljavni kazenskopravni ureditvi Republike Slovenije. Naša kazenskopravna zakonodaja določa, da je za mladoletne storilce kaznivih dejanj treba šteti vse tiste storilce, ki še niso dopolnili 18 let, posebne določbe pa se pod določenimi pogoji uporabljajo tudi za polnoletne, kadar se jim sodi za kazniva dejanja, ki so jih storili kot mladoletniki, izjemoma pa se uporablja tudi za tiste, ki so storili kaznivo dejanje kot mlajši polnoletniki. Kot prva in hkrati univerzalna kazenska sankcija se štejejo vzgojni ukrepi, ki se lahko izrečejo mlajšim in starejšim mladoletnikom, kot tudi mlajšim polnoletnikom. Vzgojni ukrepi veljajo za glavnino potrebnega posebnega obravnavanja mladoletnikov in se delijo v dve skupini: na zavodske in nezavodske ukrepe. Druga vrsta kazenskih sankcij so kazni za mladoletnike, ki se lahko izjemoma izrečejo samo starejšim mladoletnikom, pri čemer ločimo dve glavni kazni (mladoletniški zapor, denarna kazen) in stransko kazen(prepoved vožnje motornega vozila). Varnostni ukrepi pa so tretja in tudi zadnja vrsta kazenskih sankcij, ki se lahko izrečejo obema skupinama mladoletnikom. Opozorilnih sankcij za mladoletnike naš kazenskopravni sistem za mladoletnike ne pozna. Veljavna materialna ureditev mladoletniškega kazenskega prava torej ponuja široko možnost izbire med različnimi kazenskimi sankcijami za mladoletnike, vendar se senati za mladoletnike še vedno v večini odločajo za izrekanje nekaterih nezavodskih varnostnih ukrepov. Namen kazenskih sankcij za mladoletnike je: vzgoja, prevzgoja in pravilno usmerjanje. Zaradi slednjega je primerjava s kazenskimi sankcijami za polnoletne storilce kaznivih dejanj skoraj nemogoča že zaradi zasledovanja različnih ciljev sankcioniranja. Materialna vprašanja so zaenkrat urejena še v posebnem poglavju starega kazenskega zakonika, kateri velja do sprejetja posebnega zakona za mladoletnike.

Secondary abstract: |
This diploma thesis addresses the system of criminal sanctions for juvenile offenders in the current criminal justice legislation of the Republic of Slovenia. Our criminal legislation determines juvenile offenders as all offenders under the age of 18 years, special statutory provisions under certain terms and conditions also apply to adults, when they committed offenses as minors. Those provisions apply as well to those who have committed a criminal act as Young adults. As the first and also as a universal sentence, educational measures are considered, which may be imposed on younger and older minors, as well as younger adults. Educational measures represent the majority of the required special treatment of minors and are divided into two groups: institutional and non-institutional measures. Another type of criminal sanctions are the sanctions for minors, which may exceptionally be imposed only for older minors, where we distinguish between two main punishments (juvenile prison and a fine) and a lateral punishment (prohibition of driving a motor vehicle). Security measures are the third and last type of criminal sanctions, which may be imposed on both groups of minors. Warning measures for minors are not present in our criminal justice system. Valid substantive rules of juvenile criminal law, therefore, offer a wide range of different criminal sanctions for minors, but the panels for juveniles still mainly decide to use non-institutional security measures. The purposes of criminal sanctions for minors are: education, rehabilitation and proper guidance. These are completely different from the purposes of criminal sanctions for adults, which makes both sanctioning extremely hard to compare. Material issues are currently being regulated in a separate section of the old Penal Code, which applies till the adoption of a special law for minors. |
