Abstract

Kulturna dediščina predstavlja nenadomestljivo vrednoto, saj je vsaka enota kulturne dediščine, ki je poškodovana ali uničena, žal izgubljena. Zato je potrebno kulturno dediščino vključiti v aktivno vsakodnevno življenje. Skrb za njeno ohranjanje in varovanje v vseh okoliščinah je skrb vsakogar izmed nas. Tema diplomske naloge je posebna varstva lastninske pravice, to je lastninska pravica nad kulturno dediščino. Lastninsko pravico lastnik izvršuje tako, da ne omejuje drugih posameznikov ali krši zakona. Omejitve lastninske pravice, ki se pojavljajo, se ločijo, na tiste ki so naložene v javnem interesu in tiste, ki varujejo zasebne interese. Varstvo kulturne dediščine je potrebno vključiti v aktivno vsakodnevno življenje. V kategorijo kulturne dediščine, ki je najpogostejša, sodijo posamezne stavbe ali nepremični objekti. Ločimo registrirano dediščino, ki nima statusa spomenika in je varovana le posredno in kulturne spomenike, pri katerih so opredeljeni ukrepi varstva, sofinanciranje in pravica do raznih nadomestil.

Secondary abstract: Cultural heritage is an irreplaceable value, because each unit of cultural heritage that is damaged or destroyed, unfortunately, lost. It is therefore necessary to include cultural heritage in active daily life. Concern for its preservation and protection in all circumstances is a concern every one of us. The theme of this work is special protection of property rights, that is, the right of ownership of cultural heritage. Property right owner exercised so as not to restrict other individuals, or violates the law. Restrictions on property rights that arise, separate to those imposed in the public interest and those that protect private interests. Protection of cultural heritage should be included in the active daily life. In the category of cultural heritage, which is the most common include individual buildings or stationary objects. They are classified as registered heritage, which has no monument and is protected only indirectly and cultural monuments, which are defined measures of protection, and the right to co-finance various allowances.
