Abstract

Diplomsko delo z naslovom »Analogija v sodni praksi slovenskih sodišč« ima dvojni pomen. Predstavlja zaokroženo celoto in sistematični prikaz analogije v teoriji ter sodni praksi, kar je rezultat avtorjevega celoletnega raziskovanja, hkrati pa predstavlja temelj za nadaljnje raziskovanje na področju analogije v sodni praksi. Menim, da diplomsko delo bralcu omogoči globok vpogled v tematiko, tako s teoretičnega kot tudi s praktičnega vidika. Po uvodni predstavitvi pravnih praznin in razlogov za njihov nastanek, lahko bralec obudi znanje o analogiji, ki ga je pridobil pri predmetu pravoznanstvo, hkrati pa se mu predstavijo nova spoznanja in koncepti, ki v teoriji še niso bili razdelani. Diplomsko delo se seveda dotika tudi drugih vprašanj, ki so vsaj posredno povezana z analogijo, kot je na primer sistemizacija pravnih panog v javno in zasebno pravo, odnos med posameznimi panogami v smislu nad- in podrejenosti ter podobna vprašanja, ki so pomembna za razumevanje predmeta diplomskega dela. Zadnje poglavje je namenjeno predstavitvi sodne prakse in vprašanjem, kako praksa dojema analogijo in jo uporablja v vsakodnevnih pravnih operacijah, v sklepnem delu pa so podane končne ugotovitve in izhodišča, na katerih bo temeljilo nadaljnje raziskovanje v naslednjem oziroma naslednjih delih.

Secondary title: ANALOGY IN THE CASE LAW OF SLOVENIAN COURTS
Secondary abstract: The degree's work entitled »Analogy in the case law of Slovenian courts« pursues two objectives. It represents a complete and systematic view of the analogy in theory and judicial practice, which is a result of the author's year-long research, and it is also a foundation for further research in the field of analogy in case law. I believe that the thesis provides a deep insight into the theme, both from a theoretical, as well as a practical point of view. After the introductory presentation of legal gaps and the reasons for their creation, the reader is able to incite his knowledge of analogy, which he has acquired in the course of Theory of Law. Furthermore, he is presented with new insights and concepts, which in theory had not yet been elaborated. The degree’s work also reaches other issues, that are, at least indirectly, linked with the analogy, such as systemization of legal branches in public and private law, the relationships between branches and similar issues which are important for the understanding of the thesis. The last chapter is devoted to the presentation of case law and question of how practice is perceived and used by analogy in everyday legal operations. In the final part, we are given the final findings and considerations on which further research will be based on.
