Abstract

Intelektualna lastnina je pojem, ki zajema različne vrste pravic, kamor uvrščamo patente, modele, znamke, avtorsko pravico ter druge pravice. Te pravice omogočajo inovatorjem in vlagateljem tržno korist od njihovih stvaritev. Zaradi velike konkurence na trgu se dandanes tržni subjekti identificirajo z znamkami, ki potrošnikom zagotavljajo zakonite, varne in zanesljive izdelke. Blagovne znamke se zaščiti z registracijo, tako v Sloveniji kot tujih državah, na naslednje načine: z nacionalno prijavo, mednarodno prijavo, evropsko prijavo ali regionalno prijavo. V primeru nedovoljenega izkoriščanja pravic intelektualne lastnine se kršitelja prijavi. Zoper le-tega se lahko sprožijo ukrepi civilne, upravne ali kazenske narave.

Secondary abstract: Intellectual property is a term that covers different types of rights, i.e. patents, designs, trademarks, copyright, and other rights. These rights provide market benefit to innovators and investors. Due to the fierce competition on the market, market entities are identified by brands, which provide customers with legal, safe, and reliable products. Both in Slovenia and abroad, trademarks are protected by registration in the following ways: national application, international application, European application, or regional application. In the event of unauthorized rights exploitation of intellectual property, the offender shall be reported. Measures of civil, administrative, or criminal nature can be initiated.
