Abstract

Po pismu evropske poslanke Annelise Dodds, v katerem očita vodilnim v Formuli 1, da s svojimi dejanji omejujejo konkurenco, Evropska komisija razmišlja, da bi ponovno odprla postopek proti Formuli 1. Natančneje, Formuli 1 se očitajo tri kršitve: (i) kršitev dogovora med FIO in Evropsko komisijo iz leta 2001 in ponovno vzpostavljanje nadzora nad tako komercialnimi kot tudi regulacijskimi pravicami, (ii) nepravično obravnavanje manjših ekip, s tem ko so izločene iz odločanja o pomembnih vprašanjih, ki zadevajo Formulo 1 in (iii) neenakomerna porazdelitev dobička iz komercialnih pravic med ekipami Formule 1. Zagovorniki Formule 1 se branijo očitanih kršitev z argumenti, da zaradi posebne narave športa konkurenčno pravo EU ne zavezuje Formule 1 in da zato ne obstajajo kršitve konkurenčnega prava. Na drugi strani nasprotniki trdijo, da z ekonomskim vplivom, ki ga ima Formula 1, njena dejanja spadajo pod pravo EU. Zaradi posebne narave športa in različne argumentacije se pojavlja vprašanje, ali Formula 1 krši konkurenčno pravo ali pa njena dejanja spadajo pod posebno naravo športa in zato kršitve ne obstajajo.

Secondary abstract: According to a letter from a member of European parliament Annelise Dodds, which accuses the leading people of Formula 1 of actions that limit competition, the European Commission is considering to re-open proceedings against Formula 1. Specifically, Formula 1 is accused of three violations: (i) breach of the Arrangement between the FIA and the European Commission from 2001 and re-establishing control over both commercial and also regulation rights, (ii) unfair treatment of small teams by executing them from decision-making and (iii) uneven distribution of income from broadcasting rights between teams. Formula 1 proponents defend themselves with an argument that the special nature of sport puts Formula 1 outside of EU competition law. On the other hand, opponents argue that because of the economic impact of Formula 1, its actions fall under EU law. Due to the specific nature of sport and different line of arguments, the question is whether Formula 1 infringes competition law or do its actions fall under the specific nature of sport so there is no infringement at all.
