Abstract
Nastajanje velikih količin e-odpadkov, neustrezna okoljska zakonodaja, podhranjenost državnih organov, delovanje organiziranih kriminalnih združb ipd. predstavljajo globalne probleme, ki se jim ne more izogniti niti Slovenija. Ker nas je zanimalo, kako obsežna je omenjena problematika v Sloveniji, smo le-to raziskali in podatke analizirali. Rezultati raziskave kažejo, da ljudje kljub aktivnemu ozaveščanju o varovanju okolja še vedno ne razumejo pravega pomena pojma e-odpadki, kaj šele, da bi se zavedali nevarnosti njihovega nepravilnega odlaganja. V Sloveniji delujejo štiri skupne sheme za ravnanje z odpadki (Zeos, Interseroh, Slopak in Trigana), a je kljub temu na določenih območjih še vedno moč opaziti kupe nepravilno odloženih e-odpadkov. Poleg naštetega je slovenska okoljska zakonodaja slabo urejena in dopušča nepravilnosti, ki jih največkrat izkoristijo organizirane kriminalne združbe. Prepletenosti zakonitih in nezakonitih dejavnosti predstavlja veliko težavo organom pregona pri odkrivanju ter dokazovanju kaznivih dejanj povezanih z okoljem. Kadar sodišča uspejo dokazati krivdo, so kazni izjemno nizke in skoraj brez učinka, kar nam sporoča, da je ekološka kriminaliteta še kako privlačna ter donosna. Anomalije se pojavljajo tudi pri evidentiranju posameznih količin e-odpadkov, kar smo ugotovili pri pregledu analiz, ki so nam jih posredovale pristojne službe. Ugotovili smo, da je stanje na področju ravnanja z e-odpadki potrebno ponovno preučiti, vzpostaviti ustrezno strukturo dela, preurediti okoljevarstvene pravne akte po zgledu uspešnejših držav, zahtevati višje sankcije za storilce ekološke kriminalitete in vzpostaviti učinkovit nadzorni sistem.

The generation of large quantities of e-waste, inadequate environmental legislation, malnutrition of national authorities, the activities of organized criminal groups etc. they represent global problems, which cannot be avoided even in Slovenia. Because we were interested in how widely are the mentioned problems in Slovenia, we have to investigate and analyze the results. Research results show that people despite actively raising awareness about environmental protection, still do not understand the true meaning of the concept of e-waste, let alone to be aware of the dangers of their improper disposal. Slovenia has four common scheme of the waste (Zeos, Interseroh, Slopak in Trigana), but in certain areas can still be seen heaps improperly landfilled e-waste. Nevertheless, the Slovenian environmental legislation is badly regulated and allows anomalies, which often take advantage of the organized crime groups. The interweaving of legal and illegal activities is a major problem for law enforcement agencies, to uncover and proving crimes related to the environment. When the Court are able to prove guilt, are penalties extremely low and almost without effect. This tells us that ecological crime is attractive and profitable. Anomalies also appear in the recording of certain quantities of e-waste, which we have found through reviewing the analyzes, provided by our competent services. After finishing the research, we found that the situation in the management of e-waste is necessary to re-examined, establish a corresponding structure of work, rearrange environmental acts following on example of successful countries, require higher penalties for offenders of environmental crime and establish an effective control system. |
