Abstract
V diplomskem delu je obravnavana tematika pogrešanih oseb, ki so vsakdanji tako družbeni kot kriminalistični problem in v mnogo primerih izginejo brez sledi. Ni nujno, da je izginotje posledica kaznivega dejanja, a se lahko velikokrat konča zaradi velikih težav in konfliktov. V ozadju prijave o pogrešanosti in navidezno prostovoljnega odhoda so lahko duševna bolezen, nesreča, samomor, lažna prijava ali pa dobro prikrito in načrtovano kaznivo dejanje — umor.
Vzroki so nepojasnjeni, storjeni v čudnih in sumljivih okoliščinah, in pojavijo se indici, da je pogrešana oseba morda žrtev kaznivega dejanja. Takrat se z iskanjem pogrešanih oseb začnejo ukvarjati kriminalisti s področja krvnih deliktov. Da bi ugotovili, kaj se je s pogrešano osebo v resnici zgodilo, je naloga preiskovalcev zbiranje, ugotavljanje dejstev in dokazov o okoliščinah pogrešanosti. Pomembno je ugotoviti motiv za izginitev in morebitni motiv za umor. Na sum umora pogrešane osebe lahko kažejo tudi osebnostne lastnosti, značilnosti in navade pogrešanega, pri tem pa je bistvena tudi njegova preteklost. Ključnega pomena za razrešitev primera, da se odkrije storilca in da se mu dokaže krivda, so indici, pridobljeni na kraju, kjer je bila oseba videna nazadnje, ter dokazi, najdeni na kraju umora in na kraju najdbe trupla, če se ta najde.

This thesis deals with missing persons who often disappear without leaving a trace; they are a social and forensic issue. A disappearance is not necessarily the result of a criminal offence. However, that mey be the case due to serious issues and conflicts. The reasons for people disappearing and seemingly leaving voluntarily may lie in mental illness, accident, suicide, or false report. But a well-concealed and planned criminal offencemurder—is also possible.
If the causes are unexplained and the offence happened in unusual and suspicious circumstances, clues may suggest that the missing person could have been the victim of a criminal offence. At that moment criminal police officers dealing with violent crime take over. Their task is to determine what truly happened to the missing person by collecting information, establishing facts and finding proof about the circumstances of the disappearance. It is also important to determine the motive for disappearance and the possible motive for murder. The suspicion of murder of a missing person is also related to that person's personality traits, characteristics, habits as well as their past. The key to resolving a case, finding the perpetrator and proving them guilty are clues acquired wherever the missing person was last seen, and proof found at the scene of murder and where the body was found, if it was found at all. |
