Abstract
Evropska unija predstavlja največje svetovno gospodarstvo z največjim enotnim notranjim trgom. Skupna trgovinska politika je eno izmed prvih področij političnega sodelovanja na ravni Evropske unije, pri katerem so države članice podelile del svoje suverenosti njenim institucijam. S skupno trgovinsko politiko Evropska unija določa smernice, pri čemer pa igrajo pomembno normativno vlogo mednarodni sporazumi, ki jih ta sklepa s tretjimi državami. Evropska unija se je morala soočiti s spremenjeno strukturo in vzorci mednarodne trgovine, ki so jih prinesli novi ekonomski igralci, tehnološki dosežki in svetovna finančna kriza. Z namenom zagotovitve gospodarske rasti in delovnih mest je določila ukrepe, ki naj med drugimi omogočijo tudi večjo transparentnost, demokratičnost in legitimnost Evropske unije. Pri tem je najpomembnejšo vlogo odigrala uveljavitev Lizbonske pogodbe. Slednja je bistveno okrepila vlogo Evropskega parlamenta, med drugim tudi s povečanjem njegovega vpliva na oblikovanje skupne trgovinske politike v postopkih sklepanja mednarodnih trgovinskih sporazumov.
Problem, ki je v magistrskem delu analiziran, je vloga Evropskega parlamenta kot predstavniškega organa državljanov Evropske unije, v institucionalni verigi Evropske unije in njenega vplivanja na mednarodno trgovino. Naloga opredeljuje vlogo Evropske unije v mednarodni trgovini na podlagi osnovnih statističnih podatkov njenega delovanja in njenega vpliva v Svetovni trgovinski organizaciji. Delo obširneje razlaga pomen mednarodnih sporazumov, njihov razvoj in postopek sklepanja ter se pri tem osredotoča na mednarodne trgovinske sporazume. Z namenom čim boljšega prikaza vloge Evropskega parlamenta v mednarodni trgovini je v delu najprej razložena njegova funkcija in na kratko prikazan razvoj povečevanja njegovih pristojnosti. V osrednjem delu magistrske naloge je predstavljena vloga Evropskega parlamenta pri sklepanju mednarodnih trgovinskih sporazumov, ki je razdeljenega na dve časovni točki – pred in po uveljavitvi Lizbonske pogodbe. Delo v celoto zaključuje šest primerov vplivanja Evropskega parlamenta na zadeve skupne trgovinske politike - Sporazum o prosti trgovini med EU in Republiko Korejo, Sporazum o posredovanju bančnih podatkov evropskih državljanov ZDA (SWIFT), Mednarodni trgovinski sporazum proti ponarejanju (ACTA), Čezatlantsko trgovinsko in naložbeno partnerstvo (TTIP), Celovit gospodarski in trgovinski sporazum med EU in Kanado (CETA) ter odločitev Evropskega parlamenta v zvezi z vprašanjem priznanja statusa tržnega gospodarstva Kitajski.
Evropski parlament je z uveljavitvijo Lizbonske pogodbe pridobil v okviru sklepanja mednarodnih trgovinskih sporazumov večjo politično moč, kar pa ima pomembno posledico tudi pri zagotovitvi večje preglednosti razprave v okviru postopkov pogajanj in same sklenitve mednarodnih trgovinskih sporazumov. Odslej Evropski parlament predstavlja enega glavnih akterjev na tem področju in njegovega vpliva na mednarodno trgovino ne gre zanemariti.

The Role of European Parliament in the International Trade |

European Union is the world’s largest economy with the largest internal single market. Common commercial policy represents one of the first areas of political cooperation in which European Union’s member states gave part of their sovereignty to its institutions. It is also a guideline for European Union’s participation on the international market. A great part of its common commercial policy is embodied by conducting international trade agreements with third countries. In order to confront the changes in international market, made by new economic players, technologic achievements and global financial crisis, European Union had to adopt new measures. This has been accomplished with the entry in to the force of the Lisbon treaty, which was set to bring economic growth and new jobs, as well as improvement of transparency, democracy and legitimacy of the European Union. Enforcement of the Lisbon treaty also brought European Parliament’s enlargement of its hard and soft powers in the area of common commercial policy, namely in the procedure of adopting international trade agreements.
This thesis explores the role of the European Parliament in European Union’s institutional chain and its influence on the international market. It is primarily focused on the role of European Union’s role in the international market, describing the relevant statistical data and its activities at the World Trade Organisation. Thesis defines the meaning and the procedure of adopting international agreements, more so of the international trade agreements. For the purposes of displaying a broader picture of the European Parliament’s role in the international trade, it also explains its function and development of its powers. In its core part, thesis clarifies the role of the European parliament in the procedure of adopting international trade agreements, prior and subsequent to the enforcement of the Lisbon Treaty. Master thesis is completed with six showcases of European Parliament’s effect on the common commercial policy - Free trade Agreement between the European Union and the Republic of Korea, Agreement on banking data transfers to the USA (SWIFT), The Anti-Counterfeiting Trade Agreement (ACTA) and Transatlantic Trade and Investment Partnership (TTIP), Comprehensive Economic and Trade Agreement (CETA) and European parliament decision on China’s market economy status.
With the enforcement of the Lisbon Treaty, the European Parliament gained political power, which enables it to ensure more transparency, democracy and legitimacy of the procedure of adopting international trade agreements. Since that, European Parliament showed to be an important participle in the field of common commercial policy, whose effect on the international trade cannot be neglected. |
