Abstract

Z izdelavo magistrske naloge sem želela opozoriti na dejstvo, da je sklenitev in prenehanje pogodbe o zaposlitvi zelo pomemben pravni institut, ki se tiče vseh nas. Vsi ljudje se vsakodnevno srečujejo s podpisi pogodb o zaposlitvi, na žalost pa tudi s podpisi odpovedi pogodbe o zaposlitvi. To se torej ne dogaja nekje daleč stran, temveč je del našega vsakdana. Vse to pa ima pomen na življenje posameznika, saj vpliva na to, kaj bo celo življenje počel na delovnem mestu, s podpisom pogodbe pa je odvisno tudi kje bo živel, si ustvaril družino in se ustalil. Ko pride do prenehanja oziroma odpovedi pogodbe o zaposlitvi se vsak delavec znajde v stiski, postavlja se mu vprašanje, kako naj se s to izgubo sooči, katere pravice mu gredo pri odpovedi posamezne pogodbe o zaposlitvi, kakšen je postopek odpovedi… In ravno to sem sama raziskovala v svoji nalogi, ki ima poudarek na odpovedi pogodbe o zaposlitvi s strani delodajalca, katere so zakonsko obvezne sestavine odpovedi in kakšen je ta postopek. Osredotočila sem sem na prenehanje pogodbe o zaposlitvi iz krivdnega razloga in razloga nesposobnosti.

Secondary abstract: By creating this master's thesis I wanted to draw attention to the fact that the conclusion and termination of the employment contract is an important legal institution which concerns us all. People are confronted daily, with signing, and unfortunately also with terminating of employment contracts. This is not going on somewhere far away, but is a part of our daily lives. All of this affects the life of the individual and influences what he will be doing his whole life. Signing of the employment contract also defines where he will live, start a family and settle down. When it comes to termination of the employment contract each employee faces distress tied to the termination. Cancellation of the contract also raises multiple questions on how should the worker cope with the cancellation, which are his rights and what is the procedure regarding the termination of employment contract… In my thesis I predominantly explored the termination of the employment contract by the employer, legal process behind it and which are the constituent parts of termination. I put an emphasis on researching termination of the employment contract due to the fault and incompetence of the employee.
