Abstract

V magistrskem diplomskem delu se bom posvetila obravnavi Pristaniške uprave, primerjavi pristanišč, pravni podlagi za uvedbo in možnim problemom oziroma oviram pri uvedbi le-te. Pri tem se bo pokazala pomembnost in nujnost uvedbe ne zgolj na lokalni ravni, temveč tudi na nacionalni ravni. Na splošno velja, da je Pristaniška uprava poseben državni ali kvazi-državni javni subjekt. Praviloma gre za javno Pristaniško upravo, zato bom skozi delo uporabljala zgolj izraz Pristaniška uprava. Izjemoma pa obstajajo tudi primeri, kjer se Pristaniška uprava pojavlja v obliki zasebne institucije. Gre za neodvisno osebo, ki je ustanovljena ponavadi s strani zakonodajalca za posebno območje, z namenom, da upravlja z območjem posebnega javnega pomena, luko in pripadajočo infrastrukturo. Različni modeli Pristaniških uprav obstajajo po vsem svetu. V delu bom predstavila različne modele Pristaniške uprave in pri tem tudi predlagala najbolj učinkovito ter transparentno obliko modela Pristaniške uprave za posebno področje kot je Luka Koper oziroma koprsko pristanišče. V magistrskem diplomske delu bom ponekod uporabljala originalne angleške izraze, ker so del pomorske terminologije, uveljavljene na mednarodni ravni in bi se s prevodom lahko izgubil njihov pomen.

Secondary title: The possibility of implementing Port Authority in the Area Port of Koper
Secondary abstract: In my master diploma thesis I will concentrate on exploring Port Authority, comparing different models of Ports, the Legal basis for the introduction of Port Authority and potential problems or obstacles in the introduction thereof. This will show the importance and necessity of introducing Port Authority not only at Local level but also at National level. In general, Port Authority is a special State or Quasi-state entity. As a rule, it is a Public Port Authority, that is why I’ll use for it only the expression Port Authority. Exceptionally, there are also cases where the Port Authority arises as a Private Institution. Port Authority is an independent person, who is usually established by the legislature for the specific area, in order to manage specific areas of Public interest, Port and associated infrastructure. Different models of Port Authority exist worldwide. In my master diploma thesis I will present various models of the Port Authority, while also proposing the most effective and transparent model form of it for a specific Area such as Port of Koper. In the master diploma thesis, I will sometimes use the original English worlds, because they are a part of maritime terminology, established at international level and to the translation they may lose their meaning.
