Abstract

Predmet raziskave je produktna odgovornost (PO) v EU. Preučen je s pravnega, ekonomskega, kulturno-zgodovinskega, družbeno-sociološkega in politično-upravnega vidika. Rezultat je več-disciplinarna jedrnata predstavitev objektivne PO, ki jo uvaja zakonodaja EU, in do neke mere tudi civilno-pravne odgovornosti za proizvode z napako, ki se še vedno uporablja v državah članicah (DČ). Evropski model PO vsaj okvirno umesti v svetovni kontekst. Nakaže razmejitve in medsebojne vplive s področji varstva potrošnikov ter kakovosti in splošne varnosti proizvodov. Na kratko analizira in interpretira dostopne podatke o gospodarskih učinkih pravnega urejanja PO. Opravi okviren pregled (vrst) predpisov, ki na ravni EU in v DČ urejajo to področje. Posebej se poglobi v problematiko poenotenja sistema objektivne PO po vsej EU in procesa prenosa predpisov EU v pravne rede DČ. V tem procesu zazna kar nekaj težav, zato v sklepnem delu poda predlog, kako bi hitreje in lažje dosegli želeno končno stanje. Osrednji del naloge je podan v treh vsebinskih poglavjih, in sicer: POJEM PRODUKTNE ODGOVORNOSTI V STROKOVNI LITERATURI, PRESEK SKOZI ZGODOVINO PRAVNEGA UREJANJA PRODUKTNE ODGOVORNOSTI V SVETU in PRAVNA UREDITEV PRODUKTNE ODGOVORNOSTI V EVROPSKI UNIJI. Slednje obravnava tudi problematiko procesa harmonizacije prava PO na ravni EU, vključno z nekaterimi dogodki, ki ta proces zaznamujejo zadnje čase.

Secondary abstract: The subject of this research is product liability (PL) in the EU. It was analysed from legal, economic, cultural-historical, social-sociological and political-administrative aspects. As a result, the thesis provides a concise multidisciplinary introduction of strict PL, which is currently being introduced by EU legislation, and, to some extent, civil liability for defective products that is still used in the Member States (MS). The thesis places the European PL model in the global context. It points out its boundaries and interactions with consumer protection as well as the field of product quality and safety. It contains a short analysis of the available data and information on the impact that the legal regulation of PL has had on the economy and also provides comments on the outcomes. Moreover, it includes an overview of the regulations (types) governing PL at the EU level and within individual MSs. Special attention was devoted to the issue of strict PL system harmonisation across the whole EU as well as to the process of transposing the EU PL legislation into the legal systems of MSs. Since this process is evidently facing a number of difficulties, several proposals on how to achieve the desired final state more quickly and easily were put forward in the conclusion. The main part of the survey report is structured into three parts: THE NOTION OF PRODUCT LIABILITY WITHIN EXPERT LITERATURE, CROSS-SECTION OF THE HISTORY OF PRODUCT LIABILITY REGULATIONS IN THE WORLD, and LEGAL REGULATION OF PRODUCT LIABILITY IN THE EU. The latter chapter also addresses the issue of the EU-wide PL legislation harmonisation process together with some currently important events.
