Abstract
V diplomski nalogi sem pojasnil pojem pravne države, ustavnega sodišča, ter njegove pristojnosti, ustavo, kasneje skozi sodno prakso sem prikazal, kako je Ustavno sodišče RS s svojimi odločbami razvijalo načelo pravne države in vsa zelo pomembna pravna podnačela.
Ustavno sodišče Republike Slovenije je s svojimi odločbami odločilno vplivalo na potek razvoja slovenskega pravnega reda. Z ustavno določenim načelom pravne države je postavilo pravno določen okvir, katerega so se zakonodajalec, ter ostali državni organi primorani držati za zagotavljanje temeljnih ustavnih pravic.
Načela sorazmernosti, prepovedi retroaktivnosti, pravne varnosti in jasnosti pravnih norm, varstva zaupanja v pravo ter zakonitosti delovanja državnih organov so načela, katera je Ustavno sodišče Republike Slovenije razvilo neposredno iz načela pravne države. Predstavljajo uresničevanje ter zagotavljanje pravne pravičnosti, enakega pravnega oziroma sodnega obravnavanja, zakonito in legitimno izvrševanje predpisov državnih oblasti in notranjo usklajenost pravnih aktov. Iz načela pravne države je Ustavno sodišče RS tako razvilo nekatera najpomembnejša ustavnopravna načela.

In my diploma I have fully described the meaning of “Rule of law”, the Constitutional Court, its power and commitments, and finally I have shown, through the judicial practice, how the Constitutional Court has developed the principle of rule of law and all the other legally relevant principles that have been developed from the principle of Rule of Law.
The Slovenian Constitutional Court has, with its rulings, decisively impacted on the course of evolution of the Slovenian legal order. With the constitutional establishment of the principle of Rule of Law, it has set a legally defined frame, which the legislator and other state authorities are required to uphold, in order to ensure basic constitutional rights.
The principles of proportionality, non-retroactivity of law, legal certainty and clarity of legal norms, protection of legitimate expectations and the legal functioning of the state authorities are some of the most important principles that the Constitutional Court of Slovenia has developed from the principle of Rule of Law. They represent the execution and ensuring of legal justice, equal treatment under the law, legitimate enforcement of the state authorities and internal consistency of the legal acts. Therefore the Constitutional Court has developed some of the most important constitutional law principles from the principle of Rule of Law. |
