Abstract

Področje urejanja prostora in graditve objektov urejajo štirje krovni zakoni iz leta 2003, ki so bili že večkrat spremenjeni in dopolnjeni tako, da so postali nepregledni in med seboj neusklajeni, poleg tega to področje ureja kopica sektorskih zakonov in podzakonskih predpisov s področja ohranjanja narave, varstva okolja, upravljanja z vodami, kmetijskih zemljišč in gozdov, varstva kulturne dediščine. Postopek izdaje gradbenega dovoljenja je zagotovo eden izmed najzahtevnejših upravnih postopkov, v katerem se prepletata javni interes in zasebni interes posameznika. Upravni organ je v postopku dolžan varovati javni interes, hkrati pa mora paziti na to, da pravice posameznika ne omejujejo pravice drugih. Investitor mora v postopku izdaje gradbenega dovoljenja premagati številne administrativne ovire, medtem ko uradniki v upravnih enotah pogosto opozarjajo na slabo pripravljene prostorske akte, pomanjkljivo in neusklajeno projektno dokumentacijo, na veliko število med seboj neusklajenih področnih predpisov, vse to pa negativno vpliva na pravno varnost investitorjev. Zaradi povečanja zagotovitve pravne varnosti in posledično zaupanja v državni aparat bi bilo potrebno poenotiti zakonodajo na tem področju. Pomemben dejavnik v postopku pridobivanja gradbenega dovoljenja predstavljajo tudi odnosi med udeleženci postopka. Uradniki se pogosto srečujejo z jeznimi ali prizadetimi sosedi in velik dosežek je, če uradniku uspe, da se stranke med seboj pobotajo oziroma sklenejo določen kompromis.

Secondary abstract: The area of spatial planning and construction of buildings is governed by four umbrella laws from 2003 that have been repeatedly amended and supplemented so as to become untransparent and uncoordinated, moreover, it is regulated by a host of sectoral laws and regulations in the field of nature conservation, protection of environment, water management, agricultural land and forests, protection of cultural heritage. The procedure for issuing a building permit is surely among of the most complex administrative procedures, in which the public interest and the private interest of an individual are intertwined. Administrative authority is obliged to protect the public interest in the process, however care should be taken that the rights of the individual do not restrict the rights of others. An investor needs to overcome many administrative obstacles in the procedure of obtaining a building permit, while officials in administrative offices often point to the ill-prepared spatial planning acts, inadequate and uncoordinated project documentation, the large number of uncoordinated sectoral regulations, which all has a negative impact on legal certainty for investors. For the purpose of increasing the ensurance of legal certainty and consequently the confidence in the state apparatus, it would be necessary to harmonize legislation in this area. An important factor in the procedure of obtaining a building permit is represented by the relations between the parties to the proceedings. Officials are often confronted by angry or affected neighbors and it is a great achievement if an official succeeds in reconciling the parties in order to reach an agreement.
