Abstract
V magistrskem delu sem predstavil omejitve človekovih pravic in spoštovanje le teh v policijskih postopkih. Natančneje sem jih predstavil v policijskem postopku ugotavljanja identitete, ki predstavlja prvi stik s policistom. V uvodu magistrskega dela sem predstavil človekove pravice v policijskih postopkih. Tu sem predstavil etiko v policiji, Kodeks slovenske policije in Evropski kodeks policije ter varstvo človekovih pravic v policijskih postopkih. Osrednji del magistrskega dela sem namenil ugotavljanju identitete in identifikacijskem postopku. Predstavil sam postopek ugotavljanja identitete po Zakonu o nalogah in pooblastilih policije in omejitve človekovih pravic v tem postopku. Prav tako sem predstavil analizo Odločbe Ustavnega sodišča RS, št. U-I-152/03-13, o oceni ustavnosti prvega odstavka 35. člena Zakona o policije, ki je policistom dajal podlago za ugotavljanja identitete, analizo Odločbe Ustavnega sodišča RS, št. U-I-312/11-21, o oceni ustavnosti prve alineje prvega odstavka 63. člena in 64. člena Zakona o policiji, analizo Odločbe Ustavnega sodišča RS, št. U-I-271/08-19, o oceni ustavnosti tretjega in četrtega člena 56. člena Zakona o policiji in analizo Odločbe Ustavnega sodišča RS, št. U-I-272/98-26 o oceni ustavnosti prvega in drugega odstavka 49. člena Zakona o policiji.
V zaključnem delu magistrskega dela sem na podlagi tuje literature in zakonodaje predstavil analize ugotavljanja identitete v Nemčiji, v Franciji, v Avstriji, v Belgiji, v Veliki Britaniji, v Združenih državah Amerike in na Hrvaškem ter verifikacijo hipotez, ki sem jih postavil v uvodu magistrskega dela.

Secondary abstract: |
This master's thesis observes the topic of restrictions and limitations of human rights and the consideration thereof in official police procedures. Human rights are particularly observed in the frame of legal procedures for establishing a person’s identity. Such procedures namely represent the first contact of processed civilians with authorized police personnel. The introductory part of the thesis features an in-depth observation of human rights in police procedures. This section features a detailed treatment of ethics in law enforcement and policing, the Slovenian Code of Police Ethics, the European Code of Police Ethics and the concept of human rights protection in police procedures. The main part of the thesis is dedicated to the topics of establishing a person’s identity and identity-establishing procedures. This part features a detailed interpretation of the official procedures for establishing a person’s identity according to the Police Tasks and Powers Act of the Republic of Slovenia (ZNPPol) and the restrictions and limitations of human rights within the scope of these procedures. Furthermore, the thesis features an analysis of the Decision of the Constitutional Court of the Republic of Slovenia Nr. U-I-152/03-13 regarding the constitutionality of Abstract 1 of Article 35 of the Police Act of the Republic of Slovenia (ZPol), which represents the base for authorized police personnel for establishing a person’s identity, an analysis of the Decision of the Constitutional Court of the Republic of Slovenia, Nr. U-I-312/11-21 regarding the constitutionality of indent 1 of Article 63 and Article 64 of the Police Act of the Republic of Slovenia (ZPol), an analysis of the Decision of the Constitutional Court of the Republic of Slovenia Nr. U-I-271/08-19 regarding Abstracts 3 and 4 of Article 56 of the Police Act of the Republic of Slovenia (ZPol), and an analysis of the Decision of the Constitutional Court of the Republic of Slovenia Nr. U-I-272/98-26 regarding the constitutionality of Abstracts 1 and 2 of Article 49 of the Police Act of the Republic of Slovenia (ZPol). The final part of the thesis features separate analyses of official for establishing a person’s identity in Germany, France, Austria, Belgium, the United Kingdom, the United States of America and Croatia based on country-specific legal literature and relevant legislation. The conclusion of the thesis features a detailed verification of the hypotheses proposed in the introductory section. |
