Abstract
V magistrskem delu obravnavam uspešnost Evropske unije (EU) pri implementaciji in izvajanju mednarodnih sporazumov na področju podnebnih sprememb. Cilj magistrskega dela je oceniti uspešnost EU pri implementaciji in izvajanju zavez, ki jih je sprejela z mednarodnimi sporazumi o omejevanju onesnaževanja zraka na področju podnebnih sprememb. Uspešnost bom meril s tremi merili. Prvi je prenos mednarodnih zavez v notranji pravni red EU skozi uredbe in direktive, drugi je samo izvajanje zavez v državah članicah in kot zadnji je gibanje (zmanjševanje/povečevanje) emisij polutantov v državah članicah EU. V delu predstavim razvoj pravne ureditve varstva okolja v EU skozi ustanovitvene pogodbe in položaj mednarodnih okoljskih sporazumov v hierarhiji prava EU. Pogodba o ustanovitvi Evropske gospodarske skupnosti iz leta 1957 namreč ni vsebovala nobene izrecne določbe o okolju ali njegovem varstvu, šele leta 1987 sprejet Enotni evropski akt je dodal poglavje o varstvu okolja in vzpostavil pravni status varstva okolja s cilji in načeli okoljske politike, ki se je skozi kasnejše reforme pogodb nadgrajevala. V delu obravnavam mednarodne okoljske sporazume s področja varstva zraka, njihova najpomembnejša načela in zaveze, ki jih je tudi EU inkorporirala v svoje notranje pravo. Izpostavim pravilo o medsebojni izravnavi suverenosti, ki je bilo kot prvo mednarodno okoljsko načelo uveljavljeno skozi meddržavno arbitražo Trail Smelter in ne skozi mednarodni okoljski sporazum. Skozi pomembnejše pravne vire varstva zraka v EU sem analiziral uspešnost implementacije in izvajanja obravnavanih pravnih virov v nacionalno pravo držav članic EU. S pomočjo empiričnih podatkov, pridobljenih iz podatkovnih baz Evropske okoljske agencije (EEA), sem analiziral in predstavil gibanje (zmanjšanje/povečanje) emisij polutantov. Tako sem ugotovil, da je EU uspešna pri izvajanju mednarodnih zavez na področju zmanjševanja emisij toplogrednih plinov.

This masterʼs thesis describes the success of the European Union (EU) in implementing and maintaining international agreements on climate change. The aim of this thesis is to evaluate the EUʼs successfulness in adhering to the commitments it adopts in international agreements on limiting air pollution within the context of climate change. Success will be measured according to three criteria. The first is the transposition of international agreements into the internal legal order of the EU through Regulations and Directives; the second is the actual implementation of such commitments at the Member State level; and the last one is the fluctuation (increase/decrease) in pollutant emission levels in EU Member States. This thesis presents the development of legal arrangements regarding environmental protection within the EU through founding contracts and the status of international environmental agreements within the hierarchy of EU law. The founding contract for the European Economic Area of 1957 did not contain any explicit provisions on the environment or environmental protection; it was only in 1987 that the Single European Act added a chapter on environmental protection, establishing the status of environmental protection with the objectives and principles of environmental politics, which was built upon in subsequent reforms. This thesis discusses international agreements on measures regarding air pollution, its most important principles, and the commitments the EU has incorporated in its internal law. I emphasize the rule on mutual sovereignty, which was first adopted as an international principle as a result of arbitration in the Trail Smelter case, not as a result of an international environmental agreement.The successfulness of the implementation of the mentioned legal sources in the national law of EU member states is analysed through a review of the most important legal sources regarding the protection of air quality. The empirical evidence gathered from the European Environmental Agencyʼs (EEA) database also contributes to an analysis and presentation of fluctuations (decreases/increases) in pollutant emissions. It was thus determined that the EU is successful in implementing international commitments regarding the reduction of greenhouse gases. |
