Abstract
Policisti mnogihdržav se pri opravljanju svojega poklica pogosto srečujejo z migrantiin migracijami, ki so lahko regularne ali neregularne. Z njimi imajo postopke med opravljanjem kontrole cestnega ali drugega prometa, med nadzorom državne meje, med vzdrževanjem javnega reda in miru, med preiskovanjem kaznivih dejanjter ob drugih priložnostih, ki jih narava policijskega dela zahteva. V postopkih z migranti pa policisti lahko oziroma policisti smejo, glede na okoliščine, uporabljati tudi zakonsko predpisana pooblastila. Med uporabo pooblastil morajo paziti, da le teuporabljajo samo in izključno v skladu z zakonskimi določili, saj bi s prekoračitvijo le teh lahko posegli v človekove pravice in temeljne svoboščine. Zavedamo se, da so tudi policisti dovzetni na družbene vplive, zato se tudi policistom lahko zgodi, da zaradi svojih pogledov in prepričanj, ki so se jim izoblikovali tekom njihovega življenja, podležejo skušnjavam in med opravljanjem svojega poklica naredijo napake. V kolikor gre za manjše napake, ki se jih nekako da odpraviti ali popraviti, to niti ni takšna težava, v kolikor pa so te napake takšne narave, da so zaradi njih kršenečlovekove pravice in temeljne svoboščine, pa za le te ni opravičila. Med takšne neoprostljive in nedopustne napakespada tudi diskriminacija.Prav temu problemu se bomo posvetili med raziskovanjem teme magistrske naloge,ki se nanaša na diskriminacijo policistov med njihovimi postopki z migranti.Pri tem se bomo osredotočili na vzroke, zakaj do takšnih postopkov prihaja in na kakšen način lahko policistidiskriminacijo protimigrantom izkazujejo.

In the course of their work police officers in many countries often encounter migrants and migrations, which are either regular or irregular. Migrants are involved in procedures during road or other traffic control, during national border control, during the maintenance of law and order, during investigations of criminal offences and during other activities, which are required by the nature of police work. In procedures that include migrants police officers can or are allowed to use statutory powers regardless of circumstances. When using these powers they must make sure to use their statutory powers solely and exclusively in accordance with legislative provisions, as by exceeding these powers they could violate migrantsʼ human rights and fundamental freedoms. We are aware that even police officers can be susceptible to social impact; therefore, police officers too can succumb to temptations due to their perspective and belief that they have built during their lives and make mistakes during their work. In case of minor mistakes, which can be eliminated or corrected, these mistakes do not represent a big problem. However, when such mistakes violate human rights and fundamental freedoms, there is no excuse for them. One of such unforgivable and unacceptable mistakes is discrimination. This masterʼs thesis focuses on this problem and researches the discrimination of police officers during their procedures with migrants. Furthermore, the focus of this paper is placed on reasons for such procedures and on the ways police officers can discriminate migrants. |
