Abstract
Prirejanje iger na srečo je na državni ravni izključna pravica Republike Slovenije. Igre na srečo se lahko prirejajo le na podlagi dovoljenja oziroma koncesije pristojnega organa in zato je potreben nadzor nad vsemi oblikami prirejanja iger na srečo. Še posebej je potreben nadzor nad nedovoljenim prirejanjem iger na srečo, ki poteka brez dovoljenja oz. koncesije pristojnega organa Republike Slovenije. Nadzor nad nedovoljenim prirejanjem iger na srečo je zelo pomembna komponenta nadzora države nad privilegiranimi dejavnostmi, kot so igre na srečo. Igre na srečo naj bi se izvajale v nadzorovanem okolju, kjer ni prostora za kriminal in nepoštene prakse, in naj bi udeležencem iger na srečo nudile sprostitev. V strategiji razvoja iger na srečo v Republiki Sloveniji je zapisano, da iz omejitvenih določb Zakona o igrah na srečo (ZIS) izhaja skrb države, da se igre na srečo izvajajo v urejenem in nadzorovanem okolju ter da se zagotavljata varstvo potrošnikov in javni red. In prav zaradi teh določb ZIS je potreben nadzor prirejanja iger na srečo, še posebej nad tistimi, ki se prirejajo brez dovoljenja oziroma koncesije pristojnega organa. Nadzor nad nedovoljenim prirejanjem iger na srečo je potreben, da se preprečijo pranje denarja, goljufije in druga kazniva dejanja ali ravnanja v nasprotju z javnim redom, da se zaščitijo mladoletniki in druge občutljive osebe pred škodljivimi vplivi čezmernega igranja iger na srečo ter da se varujejo udeleženci iger na srečo. Nedovoljene igre na srečo se največkrat izvajajo v zasebnih prostorih, pri čemer pa inšpektorji za nadzor prirejanja iger na srečo nimajo dovolj pooblastil, da bi izvajali svoje poslanstvo, ki sta odkrivanje nedovoljenega prirejanja iger na srečo in kaznovanje odgovornih. Prav tako so kazni za tovrstne prekrške majhne v primerjavi z zaslužki, ki jih nudi nedovoljeno prirejanje iger na srečo. Nedovoljeno prirejanje iger na srečo je po 212. členu Kazenskega zakonika (KZ-1) opredeljeno kot kaznivo dejanje, za katerega je zagrožena kazen do treh let zapora. Ker pa je nedovoljeno prirejanje iger na srečo tudi prekršek, ga morajo inšpektorji za igre na srečo preganjati po uradni dolžnosti. Zaradi pomanjkanja inšpektorskih pooblastil se srečujejo s težavami pri pridobivanju dokazov, da gre za nedovoljeno prirejanje iger na srečo. Zaradi teh težav in verjetno tudi politične odločitve o ukinitvi Urada RS za nadzor prirejanja iger na srečo postaja nadzor nad nedovoljenim prirejanjem iger na srečo bolj kot ne nuja, ne pa prioriteta nadzornega organa.

Gambling is the exclusive right of the Republic of Slovenia. Gambling can be held only on the basis of an authorization or concession by the competent authority and therefore requires the supervision of all forms of gambling, in our view, particularly over the unauthorized gambling, because only those are held without permission, or concession by the competent authority of the Republic of Slovenia. In the development strategy of gambling in Slovenia is stated, that the restrictive provisions of the Gaming Act follows concern of the state, that gambling is implemented in an proper and controlled environment, for the reason to ensure consumer protection and public order. And precisely because of these provisions of the Gaming Act, supervision over gambling, especially against those who are held without permission or concession of the competent authority is necessary. Also is supervision over the illegal gaming necessary to prevent money laundering, fraud and other criminal offenses or contrary to public policy, to protect minors and other vulnerable persons against the harmful effects of excessive gambling and to protect gambling participants. Most of the illegal gambling take place in private rooms, while gambling inspectors do not have enough power to carry out its mission as detecting unauthorized gaming and punishment of those who are responsible. Penalties for such offenses are also small in comparison to the benefits offered by illegal gambling. Unauthorized gambling, according to Article 212 of the Criminal Code of the Republic of Slovenia (CC-1) is defined as an criminal offense, punished with imprisonment up to three years. Since it is unauthorized gambling also offense, must be prosecuted ex officio by gambling inspectors. Due to the lack of gambling inspectors power, they are faced with difficulties in obtaining evidence about unauthorized gambling. Because of these problems and probably also a political decisions to abolish the State Office for Gaming Supervision, control of unauthorized gaming is becoming more or less a necessity and not a priority of the supervisory authority. |
