Abstract

Diplomsko delo zajema tematiko preiskovanja organizirane kriminalitete z uporabo prikritih preiskovalnih ukrepov, s katerimi kriminalistična policija najgloblje in najintenzivnejše posega v človekove pravice in temeljne svoboščine, predvsem v zasebnost posameznika. Bistvena sestavina naloge so dokazi, ki jih kriminalistična policija naključno zazna in na njih naleti pri izvajanju ukrepa iz 1. odstavka 151. člena Zakona o kazenskem postopku (v nadaljevanju: ZKP) pri tajnem vstopu v tuje prostore. Prav ti naključno pridobljeni dokazi oziroma uporaba le-teh so, po mnenju avtorja, lahko ključnega pomena v smislu pozitivnega poteka kriminalistične preiskave ter predkazenskega in nadalje kazenskega postopka. V dosedanji sodni praksi še ni zaznati primerov iz katerih bi izhajale posledice uporabe takšnih dokazov v predkazenskih in kazenskih postopkih. Ker uporaba takšnih dokazov še ni točno določena in pravno nedefinirana je namen avtorja, da se na podlagi veljavne zakonodaje, sodne prakse in strokovne literature predstavi optimalen način zavarovanja, evidentiranja oziroma dokumentiranja takšnih dokazov z namenom uporabe v nadaljnjih postopkih. Cilj uporabe takšnih dokazov je, da le-ti ne bodo izločeni kot dokazi, ki so bili pridobljeni s kršitvijo temeljnih človekovih pravic in svoboščin ali s kršitvijo določb ZKP, kar pomeni, da njihova uporaba ne bo imela negativnih posledic v nadaljnjih postopkih. Na podlagi izdelanega načina zavarovanja, evidentiranja oziroma dokumentiranja takšnih dokazov ob dejstvu, da slovenska zakonodaja to omogoča, je naloga kriminalistične policije in tožilstva, da ob zaznavi takšnih dokazov slednje uporabi v predkazenskem in kazenskem postopku. Le na tak način bo v bodoče nastala sodna praksa, ki bo konkretneje narekovala načine evidentiranja in izkazovala posledice uporabe takšnih dokazov v kazenskih postopkih.

Secondary title: Using evidence obtained by accident within measures according to article 151 of the criminal procedure act of criminal proceedings
Secondary abstract: The thesis covers the topic of investigating organized crime with use of covert investigative measures with which the Police intervenes most deeply and invasive in the human rights and fundamental freedoms, especially in the privacy of individual. An essential component of the tasks are evidence to the criminal investigation police, random detect in the implementation of the measure from 1. paragraph 151. article of the code of criminal procedure (in hereinafter referred to as: the CCP) for the clandestine entry into the foreign spaces. Also this random obtained evidence or the use of these, may, in the opinion of the author, be of crucial importance in the context of a positive on-going criminal investigation, pretrial proceedings and further criminal proceedings. In the current case-law cases, which would result consequences of the use of such evidence in pre-trial and criminal proceedings have not been detected yet. Since the use of such evidence is not yet precisely defined and legally undefined, it is intention of the author to present, on the basis of existing legislation, jurisprudence and professional literature, an optimal way of insurance, registration or documentation of such evidence to be used in further procedures with intention, that the use of such evidence will not have negative consequences in further proceedings in the sense that such evidence will not be excluded as evidence because they were obtained with violation of fundamental human rights and freedoms or violation of ZKP provisions. Based on an insurance mode, recording or documenting such evidence and the fact that Slovenian legislation allows this, it is the task of the criminal police and the prosecution that on detection of the use of such evidence, these are used in pre-trial and criminal proceedings. Only this way, future case law will specifically dictate ways of recording and show the consequences of the use of such evidence in criminal proceedings.
