Abstract
V magistrskem delu bo obravnavano vprašanje pristopa EU k EKČP. Pravni temelj za pristop predstavlja člen 6 PEU, ki ga je predstavila Lizbonska pogodba. Vendar sama sprememba člena 6 ne zadošča, da bi EU postala pogodbenica EKČP. Za takšen rezultat mora EU izpogajati specifičen sporazum o pristopu s Svetom Evrope, katerega vsebina že dalj časa sproža velike polemike.
Po napornih pogajanjih in usklajevanjih je bil leta 2013 oblikovan Osnutek sporazuma o pristopu EU k EKČP. Žal tudi vsebina Osnutka sporazuma sama po sebi ne zadošča za uradni pristop EU k EKČP, saj se pojavljajo številne procesne, institucionalne in vsebinske ovire, ki imajo pomemben vpliv na morebiten dokončen pristop EU k EKČP. Nanje je opozorilo Sodišče EU v Mnenju 2/13, v katerem je trudoma izpogajani Osnutek sporazuma označilo za nezdružljivega s pravom EU in opozorilo na več težavnih vprašanj, ki naj bi jih odpiral. V magistrskem delu so predstavljene načrtovana ureditev iz Osnutka sporazuma, stališča Sodišča EU iz problematičnega Mnenja 2/13 in analiza možnih odzivov na izpostavljene težave in predloge Sodišča EU. Zaradi večnih kritik EU in Mnenja 2/13 se postavlja vprašanje, ali je pristop EU k EKČP glede na predstavljeno dejansko stanje sploh še možen, če je odgovor na to vprašanje pritrdilen, pa tudi, če je pristop sploh še zaželjen (oz. koristen).

Is EU accession to ECHR still possible? |
Secondary abstract: |
The thesis deals with the question of possible EU accession to the ECHR. The legal basis for accession can be found in Art. 6 TEU, brought forth by the Treaty of Lisbon. The wording of Art. 6 TEU is unfortunately not sufficient to make EU one of the signatories of the ECHR. EU must also agree with the Council of Europe on the substance of an Accession Agreement, which seems to be a greater problem than previously expected.
A Draft Accession Agreement was formed in 2013 after years of strenuous negotiations. Regrettably, even the Draft Accession Agreement does not suffice for an official EU accession, since there are plenty of procedural, institutional and substantial obstacles. CJEU shed some light on them in its Opinion 2/13, in which it ruled the Draft Accession Agreement as incompatible with EU law. This thesis shortly introduces the content of the Draft Accession Agreement, Opinion 2/13 and analyzes the possible solutions to the mentioned obstacles and suggestions of the CJEU. It also deals with the plentiful critiques of the EU and Opinion 2/13 and questions, whether accession in the current situation even remains an option, and if it does, whether accession is even still desirable (or beneficial). |
