Abstract
Pojem agencije se pred uveljavitvijo Zakona o javnih agencijah (v nadaljevanju ZJA) leta 2002 v dotedanji ureditvi ni uporabljal enotno, saj so poimenovanje uporabljali organizacijsko različni javnopravni subjekti (npr. Agencija za energijo, Agencija za trg vrednostnih papirjev itd.), kot tudi organi v sestavi ministrstva.
Zaradi zmede na področju poimenovanja subjektov javnega sektorja se je pojavila potreba po sprejetju sistemskega zakona, za odpravo anomalij na tem področju. S sprejemom ZJA se je uredila statusna oblika nosilcev javnih pooblastil in njihovo delovanje. Namen javnih agencij je zmanjševanje obsega državne uprave ter zadovoljevanje potreb po neodvisni regulaciji (tj. samostojnem urejanju določenega področja). Nekaj let po uveljavitvi ZJA se je v praksi izkazalo, da je ureditev javnih agencij v nekaterih delih neustrezna. Na to je opozorilo Računsko sodišče Republike Slovenije v revizijskem poročilu in od vlade zahtevalo ureditev spornih določil. Vlada se je na revizijsko poročilo odzvala z ukrepi, ki jih je Računsko sodišče v porevizijskem poročilu označilo kot zadovoljive. Zavezala se je spremeniti ZJA v delih postopka ustanovitve javne agencije, učinkovitejše in preglednejše upravljanje, načrtovanje dela ter poročanje direktorja, kar je storila z Zakonom o spremembah in dopolnitvah Zakona o javnih agencijah, ki je trenutno v obravnavi v državnem zboru.

Before the implementation of Public Agencies Act (ZJA) in year 2002, a term agency was not used uniformly; it was used by various organizational entities (i.e. the Energy Agency, Securities Market Agency, etc.) as well as authorities in the composition of the ministries.
Due to confusion in the naming of public sector entities there was a need to adopt a framework law to eliminate the anomalies in this area. With the adoption of the ZJA the status form of a public entities and their functioning became regulated. The purpose of public agencies is to reduce the size of the state administration and meet the needs for independent regulation (i.e. independent regulation of particular area). A few years after the adoption of the ZJA in practice it turned out that the regulation of public agencies in some areas is inadequate. The fact that ZJA is lacking the quality required was stressed out by the Court of Audit of the Republic of Slovenia in the audit report. The report demanded that the Government regulate the disputed provisions. The Government responded to the audit report with measures that the Court of Audit in the post-audit report described as satisfactorily.
The Government committed to change the ZJA’s procedure for establishing agencies, provide more efficient and transparent management and improve planning of work and reporting of the director. The changes were submitted by the Act amending Public Agencies Act, which is currently being discussed in the National Assembly. |
