Abstract

Pravo podeljevanja koncesij na ravni EU ni bilo enotno urejeno vse do leta 2014. Praznino ureditve je poskušala krpati praksa Sodišča Evropske unije in napotitev, s strani Komisije preko razlagalnih sporočil, na uporabo temeljnih načel delovanja notranjega trga (načela enakosti, transparentnosti, sorazmernosti, vzajemnega priznavanja). Odsotnost pravilne regulacije je povzročila gospodarsko neučinkovitost, neoptimalno uporabo javnih sredstev in razmah okolja dovzetnega za korupcijo, ki je v končni fazi šibilo notranji trg. Na obzorju je nova ureditev podeljevanja koncesij, ki jo vnaša Direktiva 2014/23/EU Evropskega parlamenta in Sveta z dne 26.02.2014 o podeljevanju koncesijskih pogodb. Pojem koncesij je v slovenskem pravnem redu širši, kot domet Direktive 2014/23/EU. Čeprav je bistvo tega dela predstaviti spremembe in novosti, ki jih ta direktiva vnaša je hkrati enako pomembno poznavanje trenutne ureditve postopka podeljevanja, ki bo predmet sprememb. Za celostno sliko pa je v tem delu predstavljen tudi temeljen pojem koncesije, tako kot ga pozna slovensko pravo in pravo EU.

Secondary abstract: The EU’s lack of regulation, until 2014, in the area of awarding concessions contracts enabled an environment susceptible to economic inefficiency, national favouritism, misuse of public funds and corruption which weakened the Internal market. The European courts tried to fill the unregulated void with little success, as did the European Commission through various Communications. Finally, in 2014 the Directive 2014/23/EU of the European parliament and of the Council on the award of concession contracts was adopted. The concept of concessions in Slovenia is wider than that of the scope of the Directive 2014/23/EU. Even though the purpose of this thesis is to present the main novelties and changes the Directive 2014/23/EU institutes, a sufficient analysis, concerning the current state of the procedure of awarding concessions is, for the better understanding of the changes being made, necessary. And with the same goal in mind, the thesis also concerns the concept of concessions through both the Slovenian’s and EU’s regulation.
