Abstract

V socialnem tržnem gospodarstvu je delujoča oziroma učinkovita tržna konkurenca ena temeljnih predpostavk za blaginjo. Glede na to ne preseneča, da je tržna konkurenca pri nas ustavna kategorija (predvidena je tudi v PEU in PDEU ter v Ustavi Republike Slovenije). Pravila o tržni konkurenci načeloma veljajo za vse gospodarske dejavnosti, tudi za dejavnost zavarovalništva. Zavarovalništvo je po naravi stvari ena pomembnejših dejavnosti, ki je pogoj za normalno delovanje gospodarstva in nasploh družbe ter je temu primerno tudi močno regulirana. Podjetja, ki izvajajo to dejavnost, morajo upoštevati številna pravna pravila, ki omejujejo njihove tržne odločitve in ravnanja, vključno s pravili o tržni konkurenci. Pravila o tržni konkurenci med drugim prepovedujejo omejevanje tržne konkurence z omejevalnimi sporazumi, sklepi podjetniških združenj ali/in usklajenimi ravnanji. V tej nalogi je poudarek ravno na slednjem, pri čemer sta v ospredju 101. člen PDEU in 6. člen ZPOmK-1. Poudarek je na razlikovanju primerov, ko je sodelovanje zavarovalnic dovoljeno in koristno, ter primerov, ko gre za prepovedano omejevalno koordinacijo.

Secondary title: Restrictions of competition in the insurance sector under article 101. TFEU
Secondary abstract: An active or an effective market competition is one of the fundamental premises for prosperity in a social market economy. With this in mind, it is not surprising that market competition is a constitutional category in our country (it is foreseen also in the TEU, TFEU and the Constitution of the Republic of Slovenia). The rules of the market competition are in principle applied to all economic activities, including insurance. Insurance is, by the nature of things, one of the most important activities. It is essential to normal operation of economy and society and is therefore highly regulated. The companies that carry out this activity must observe numerous rules of law which regulate their market decisions and actions, including the rules of market competition. The rules of market competition prohibit, inter alia, restriction of market competition by way of cartel agreements, decisions by associations of undertakings and/or concerted practices. This thesis focuses on the latter, while bringing Article 101 TFEU and article 6 Prevention of Restriction of Competition Act to the forefront. There is an emphasis on the differentiation of cases where the cooperation between insurance companies is permitted and beneficial, and the cases where the restrictive coordination is forbidden.
