Abstract
Magistrsko delo obravnava institut kmetijske izjeme kot eno izmed vidnejših pridobitev v rastlinski biotehnologiji in v tem pogledu tudi kot pridobitev v pravu intelektualne lastnine. V skladu s to izjemo lahko kmet uporablja rastlinski zaščiten material za uporabo v poljedelstvu. Izjema pa hkrati vključuje tudi dovoljenje, da kmet svoje pridelke iz zaščitenega materiala uporablja za nadaljnje razmnoževanje na svoji kmetiji. Teorija si je na področju instituta kmetijske izjeme enotna, vendarle pa je opaziti velike težave v uporabi pravila v praksi. V magistrskem delu je zato institut kmetijske izjeme analiziran v luči sodnih odločb Sodišča EU.
Ker se institut kmetijske izjeme pojavlja tako pri žlahtniteljski pravici kot pri patentu, je v magistrskem delu najprej predstavljeno, kako se pravici med seboj razlikujeta in kakšna je uporaba kmetijske izjeme pri eni in pri drugi pravici. Ugotoviti je, da je ena izmed šibkosti tega instituta sistem nadzora, ki postavlja velik konflikt v razmerju imetnik pravice – kmet, zato je treba vzpostaviti neodvisne organe, ki bi nadzor opravljali. Prav tako se določene težave pojavljajo v zvezi z vsebino in obsegom nadomestila pri kmetijski izjemi, zato je nujen nov ali pa posodobljen izvedbeni predpis, ki bi to uredil. V sklopu analize so predstavljene možnosti izboljšanja instituta kmetijske izjeme. Ugotoviti je, da so predpisi, ki področje urejajo skopo zapisani, zato jih je v celoti treba posodobiti. Prav tako je ugotoviti, da med državami članicami prihaja do razlik v ureditvi tega področja, zato prihaja do različnih interpretacij nekaterih določb. Kljub težavam v praksi pa je glede na aktualnost biotehnologije v svetu optimistično posodobitve instituta glede takšnih pomanjkljivosti pričakovati.

Secondary abstract: |
The thesis deals with the agricultural exemption as with one of the most sightful contributions to intellectual property law in general.
The theory on the field of agricultural exemption is rather unified, however there are several difficulties when applying the rule in practice. Agricultural exemption in the thesis is presented in the light of EU case law.
The exemption states that a farmer can use plant propagating material on his own farm and moreover – with the consent of a right holder a farmer can use the product of his harvest for propagation or multiplication by him on his own farm.
Agricultural exemption as a rule is established at both – at a plant variety right and with patent. On this basis, the thesis looks more into the differences of both intellectual property rights, as well as it studies the differencies of application of the rule at both rights.
To continue, through thourough analysis there is to notice the rule afflicts with difficulties in the sense of monitoring system, which poses a big conflict of interests between a right holder and a farmer. In the light of this problem the thesis offers possible solutions to overcome those difficulties. Also, there is to perceive there are several significant problems concerning the content and the extent of remuneration. Through analysis of the EU case law thesis offers many solutions on how to upgrade the agricultural exemption system – it's urgent to constitute independent monitoring offices and upgrade the system in general. As biotechnology is a field confronted with everyday developement, there is to expect the upgrade of agricultural exemption in the future. |
