Abstract
Magistrska naloga predstavlja opredelitev zelo širokega pojma običajnega prebivališča, ki je povezan z drugimi pojmi, kot so: stalno prebivališče, začasno prebivališče in zakonsko prebivališče ter težave v zvezi z njim. Na tem področju je zelo pomembna sodna praksa, saj je Sodišče Evropske unije odločilo, da mora nacionalno sodišče ugotavljati običajno prebivališče posameznika, ob upoštevanju vseh dejanskih okoliščin posameznega primera.
Bruseljska uredba IIa ne določa definicije običajnega prebivališča, zato je pogoje za opredelitev določilo Sodišče Evropske unije. Opredelitev pojmov stalnega, začasnega in zakonskega prebivališča v Republiki Sloveniji določa Zakon o prijavi prebivališča. Za stalno prebivališče je značilna njegova trajna povezanost s posameznikom. V povezavi s stalnim prebivališčem je zakonsko prebivališče, ki omogoča registracijo prebivališča ljudem, ki nimajo stalnega prebivališča. Če posameznik določen čas prebiva izven naslova stalnega prebivališča zaradi določenih razlogov, mora prijaviti začasno prebivališče.
Z običajnim prebivališčem so povezane številne težave – lažne prijave stalnega prebivališča in fiktivni naslovi.

The master’s thesis presents the definition of a very broad concept of habitual residence, which is linked with other terms, such as: permanent residence, temporary residence and legal residence, and difficulties with reference to it. On this area is case law very important, because the Court of Justice of the European Union decided that the national court must establish the habitual residence of the individual, to take into consideration all actual circumstances of the individual case.
The Brussels Regulation IIa does not provide for the definition of habitual residence. The conditions for the definition of habitual residence are determined by the Court of Justice of the European Union. The definition of the terms of permanent, temporary and legal residence in the Republic of Slovenia is determined by the Residence Registration Act. The permanent residence is characterized by its permanent connection with an individual. In connection with permanent residence is legal residence, which makes the residence registration for people, who do not have a permanent residence possible. If an individual resides outside the address of permanent residence for certain reasons, he must register his temporary residence.
A lot of difficulties are connected with a habitual residence - false registration of permanent residence and fictive addresses. |
