Abstract

Detektivska dejavnost predstavlja pomemben člen pri zagotavljanju notranje varnosti v Republiki Sloveniji in je zakonsko močno regulirana. Eno izmed bolj kompleksnih področij detektivovega dela je zagotovo preiskovanje zavarovalniških goljufij, za kar so detektivi glede na svoja formalno določena upravičenja več kot primerni. Vloga detektiva na tem področju je ugotovitev ali gre v določenem sumljivem odškodninskem zahtevku za kaznivo dejanje goljufije ali ne in vzporedno s tem tudi pridobitev zadostne količine verodostojnih dokazov. Bistvo detektivovega dela je preverba resničnosti že zbranih informacij iz škodnih spisov in najdba novih, ki so potrebni za razjasnitev posameznega sumljivega odškodninskega zahtevka. Zaradi kompleksnosti zavarovalniških goljufij morajo imeti detektivi znanje iz številnih strokovnih področij in biti taktično ter tehnično dobro podkovani. Zavarovalniške goljufije so pogojene s številnimi dejavniki, označuje pa jih nizko tveganje za odkritje, težka dokazljivost in izrazito pomanjkanje neodobravanja s strani javnosti. Iz teh razlogov je do zavarovalniških goljufij nujna ničelna toleranca in izboljšanje ozaveščenosti ljudi o negativnih posledicah tovrstnih kaznivih dejanj. Nekatere zavarovalnice za preiskave zavarovalniških goljufij ne najemajo detektivov, ampak imajo zaposlene notranje preiskovalce, ki pa nimajo formalno urejenih metod dela in v praksi uporabljajo detektivska upravičenja. Med drugim je uporaba detektivskih upravičenj s strani oseb, ki niso detektivi, sporna tudi iz vidika varstva človekovih pravic. Glede na ugotovitve iz intervjujev, je za uspešno preiskovanje zavarovalniških goljufij na vseh področjih zavarovanj nujno potrebno učinkovito vzajemno sodelovanje med detektivi in pristojnimi strokovnjaki iz zavarovalnic.

Secondary title: The role of private detective in the investigation of car insurance fraud
Secondary abstract: Private detective activity is an important element in ensuring internal security in the Republic of Slovenia and is well regulated by law. One of the most complex areas of the detective's work is certainly investigation of insurance frauds, for which the private detectives are more than adequte, according to their formally determined entitlements. The role of private detective in this area is to determine whether there are signs of criminal offense of insurance fraud in individual fraudulent insurance claim and at the same time, the acquisition of sufficient amount of credible evidence. The essence of private detective's work is to verify the truth of already collected information from the claims files and find the new ones that are needed to clarify a single fraudulent insurance claim. Because of the complexity of insurance frauds, private detectives must have knowledge from a number of professional fields and also be tactful and technically well-trained. Insurance frauds are conditioned by a number of factors and characterized by a low risk of detection, difficulty in proving and pronounced lack of disapproval by the public. For these reasons, insurance frauds require zero tolerance and improvement of people's awareness of the negative consequences of such crimes. Some insurance companies do not hire private detectives for investigations but they have their own internal investigators, who do not have formal working methods and instead use private detective entitlements in practice. Among other things, the use of private detective entitlements by other than detectives is also controversial in terms of protecting human rights. According to the findings from the interviews, effective co-operation between private detectives and competent experts from insurance companies is necessary in order to successfully investigate insurance frauds in all areas of insurance.
